Suing Collection Agencies...

I've read lots of threads and posts here on suing CA's for breaking laws... now my question is:
How many of u here have sued and actually won?
For that matter, how many have even just sued??
Non-scientific poll here! (or is that UN-scientific?)

I,personally, haven't heard of anyone suing,I thought about it though!

I spoke with an attorney early on with my quest with one DC, and he told me it would be hard to prove-some of the regulations I brought up. I didn't have them on a recorder,etc.

I wan't sure how much they charged to represent you, etc., so never took it that far-yet!! Karen

4 wins here against CA's, but only one was with an attorney. My dh was unemployed after 9/11 and several bills went into collections. Calls became so regular I set up a answering machine next to the phone and watched caller ID and a pop in the tape for that agency. It was actually quite fun! One time a neighbor was over and one agency called so we had him answer the phone...damn agency disclosed all the facts to him on tape! When we had enough violations we simply overnighted copies of the tapes to the president and any other big wig name we could find. We stated how much we wanted for the violations and gave the a 14 day deadline. They all paid promptly.

The one we used an attorney for had no tape. This agency had my dh's cell phone and our home phone but made 4 calls to his family in another state stating that they were swearing out a warrant for his arrest and that he needed to contact them immediately. Hubby got extra damages on this due to emotional distress and embarrassment. His father who has the same name also won $1000 for being called a liar and a theft to his wife. That one netted my hubby just under $10k after attorneys fees.

allied interstate is on my hit list right now. They have been calling my cell on his bill and I have told them repeatedly that this is not his number, it is a cell phone and a business phone. I am gathering my docuentation for this one.....with phone records this will be a breeze!!

I won easy one personally against one agency for an unauthorized pull on two bureaus. I called repeatedly to find out what it was about and they had nothing on file. I asked them to remove it...they told me to dispute it. I disputed...they verified. I called back and they still had no account for me. This I got on tape. Got the pulls removed and a check for $1000.
