You cannot go to jail for defaulting on a loan. Luke is right, they are just trying to scare you. In a handful of states, they can prosecute you for a bad check, but the company would have to be legal.
Also, they cannot garnish your wages without a court order. BUT - Some pdl's will put wage assignment clauses in their contracts. With this you give them permission to take the money from your paycheck. But it is completely voluntary and revocable.

perry, if this was an internet loan, they can't claim "bad check". There is no "check". I'm posting Texas law for you. It says "unspecified". I hate that. But for them to call you and say that you're going to jail, you can bet it's not a nice legal company. No legit company would call you and tell you that you are going to jail. See if you can find out which pdl it is. Meanwhile, here's your state law.

I have had this company call me regarding a bill from my old College. They refused to work with me, but I dont care. I'm sending them a monthly payment and keeping track of my total bill.
I didn't just mail them something, I requested paper work from them stating the amount I owed. Once I did that, I checked with the BBB to find out more information regarding the company. Once I saw for myself that the company was real, I contacted my old school to find out more information. They really did send my bill to collections.
I'm currently paying them each month, I just pick a date to send out a check.
If the company does take me to court. I have the proper documentaion showing that I have been making payments each month.
Since I make payments I haven't recieved another phone call.

But, you need to know the collection agency is legit before paying them. Best advice to NOT pay illegal collection agencies. Dumb move. Cause once you "pay them off" they will call again knowing they can sucker you for more money.

Just a note out there to all of you, collection agencies have a new scam going on it is a letter that starts out per your request, to make you think that they have been contacted by you. then they go from there. It can look like a bill or a letter head from the company, but unless you have real documentation from the institution that the bill originated and the collection company that is legal to take payment then ignore and also after 3 to 6 years you can't be taken to court for a debt other than a college loan so the best thing to do is send them a letter to keep them from putting it on your credit and let it ride out. Yes it is true that you always owe the debt, but it isn't worth addressing after a period of time.

I worked for them and they are horrible. How they run things its not right. They only want money I know for a fact. Half of what they tell the people are lies and do all they can to charge you extra money. Also some of their employees partake in illegal substances and I'm pretty sure the owner knows and yet he does not do anything. I say if they do a random drug test. Which I know for a fact they would never do. Some of its "best" employees would get fired.
