First of all, you will not be garnished. These companies, as long as they're internet, are usually operating illegally. No judge in the world is going to grant a judgement to an illegal company. I have never ever seen it happen.
What they can do, though, is use a wage assignment. This is revocable by you at any time. Send them a revocation letter saying that you revoke any and all wage assignments as of this date. Also give a copy to your HR dept. This is called a letter of defense.

All of the payday loans that I have are all through the internet! One of them was orginally 300 hundred dollars and the other one was for 200 hundred! The one that is for 300, the lady told me that I owed them over 1700 dollars due to them trying to pull the fees out of my account and also them trying to pull the whole amount out of my account! She also told me that she was calling from an attorney's office and that they were trying to set up a payment plan and she asked me how much I could do and I told her about 100.00 a month! Please send the companies you are dealing with a wage assignment revocation letter and get one to your payroll dept right away. I'm serious, that is a very important first step you must take immediately. Also, did you close your bank account or put stop payments on those pdls?

So you can revoke it...but you have to tell your HR people before the ipdls sends something through...if they do it first you can't then go back and revoke it and the damage will be done. In your letter all you need is the company name and address, date and a statement saying I (you name) revoke any and all wage assignments I may have signed with your company. Your name, signature and SSN. Mail - return receipt - e-mail and fax if possible. Also give a signed copy of the letter to your payroll department. You need to do the letter asap. Right now do not worry about what the pdl's say. They will try every scare tatic to get you to pay.

You could work up a payment plan that is within you budget and make an offer, but be sure not to let them get access to your account if they accept. Let them know that you will send them a cashier's check or a money order. If they want to get paid, this is how they will get the money. Also, I would only pay them what you legally owe them. No more, no less.

amy, as fins has stated numerous times, they will not garnish your wages. They would need a court order to do this. The companies that you have posted are not even licensed/legal companies. Please stop thinking they are going to garnish your wages. Okay, so you haven't paid anything on your loans. You've already closed your bank account. Just send out the letters to the pdls revoking any wage assignment you may have signed, as posted above. Keep a copy, give a copy to your payroll department, and send them the letter certified. You will need to send each pdl a letter stating you revoke any debit authorization from your bank account (do this just for documentation purposes). Send the letters. You need to figure out exactly who you have pdls with. You need to figure out how much the actual loan was for. You need this information. Please, sit down and list the pdls by name and how much you have borrowed. We understand you haven't paid on them yet. However, you need to have accurate information for your letters that you're going to send. So you need to do this. Okay? Be calm. You're going to get phone calls & they're going to tell you all kinds of stuff. 99% of it will be illegal scare tactics. Try not to take their calls. In your letters to them, state that you will only communicate via USPS or email. No telephone calls. Do not speak with them over the phone. Okay? Please try to get your information together so that we can get some letters sent out to these people and you can pay the borrowed amount. Not any illegal fees. Okay? amy, okay. You have the information needed to send out letters. At least the dollar amounts anyway. And you have paid nothing towards them so far? Am I correct in this? So the amounts you have posted are what you owe them? You can forget about "getting bank fees" from them. You're going to be lucky if they just accept the principle amount of the loan without harrassing you night and day, let alone tell them to pay your bank fees. Forget that. Now, the majority of them will not give you a physical address to mail payments to. They want moneygrams/western union. If they want debit/credit card payments, you can always get a pre-paid VISA card. Just put the exact amount of the payment on it and give them that number as your debit/credit card payment. However, I don't believe in this personally. My thought has always been if they want their money, they will give you an address to mail it to. But whatever floats their boat. Do you need addresses for these people to mail your letters? Or do you have their contact information?

I haven't paid anything on any one of them! I do not have correct addresses on these pdl! I am not sure how to get the addresses! The lady at Geneva Roth told me if I didn't have a credit card to go out and get a prepaid credit card! So in other words just pay them what I borrowed! I read up on the site where people were having problems with Geneva Roth, and it seems like those people will not let up! I'm getting confused now! LOL! For any pdl that you have, if you have more than one address & are not sure of which to use, use them both. This will cover your butt if one is a "bad" address. Did someone turn you over to collections? Or have you just been talking to the pdls themselves? And forget about the totally crazy dollar amounts they claim you owe. They're nuts. Just tell me, have you been turned over to a collection agency by one of them? If so, who turned you over? If not, then you're just dealing with the actual pdls, right?

So the people you have been speaking with are from the collection agency? Not the actual pdl? Please clarify this for me. Also, you do not know the name of the collection agency? If you have been turned over to collections, you need something in writing stating you have been turned over to collections. You, in turn, can ask them to validate the debt. I actually got another call from another pdl, which is not on the list that I gave earlier! This one is National Cash advance and I borrowed 300.00 from them! I don't have their address either! I just talked to a debt settlement place that doesn't do payday loans, and she said a lot of debt settlement places wou;dn't touch payday loans! She also told me if they can't collect the debt from the customer then they go straight to your employer and garnish their checks! Do you have the telephone number they called you from? Do you remember anything about them? The website? Anything? I need to figure out which address it is. Also, you spoke with a debt consolidation company? You're right. There are not many who will deal with pdls. But I want you to rest assured they are not going to garnish your wages. Just treat them as individual pdls (which they are). amy, you're not trying to "escape" anything. You're just trying to get these pdls taken care of. We're going to get it to where they realize they are not licensed/legal, that you only owe the principle amount (not $2000), and that you know your laws and your rights, okay? Do not freak out. We can do this. There are many members here who have come with multiple plds and gotten great results on their own. It is a battle, but it can be done. However, if you want to "look into" companies that may be able to help with pdls, go to the right top hand side of this site and find the "search" box. Type in Langehorn debt or T&C. You can read about others who have used them. Read up on what others have said, get contact information, call them. It's okay if you do that. However, you can do it on your own if you're up for it. It's your decision. As far as giving the letters to your HR person (who is your brother), it's okay. Since your brother is the HR person, just keep the letters handy at all times in case he needs them. Don't hand him a stack of revoke letters. It's actually a plus that the HR person is your brother. He will listen to you if any of these pdls try to pull any crap on you. amy, we can help you through this if you want. Or you can look into the two companies (just do a search on them and read about them). You decide what works best for you.
