Next time when they call, answer as if you are someoneone else and tell them you no longer work there. Send them a letter requesting they validate your debt. In that letter you can instruct them to only contact you via usps or e-mail.

Ipelayo, it is ok. We have all been there. Fax it if you are comfortable with that then be sure to send it usps and certified so you will get the card back for your documentation you sent it. There may be a function on your fax machine where you can set it so it will not send out the senders fax number with the fax. You would have to look it up in the manual. That is what I did. Please be aware they may still call you.

My husband is emotionally disabled & he took out payday loans under my ss & his own. He told me about them when it was too late. I tried to make the payments but it just was too much. I have no idea how many he took out. I think 4 or 5. The most he got he told me was $300. When I realized I couldn't pay them anymore I closed out the account. I think First National Service is from Cash Net 500. I'm following Ang advice & sending them the cease & desist letter so they can stop calling me at work & I can try to make some type of payment plan. I know we paid some of the loan but I can't be sure how much. It's all so overwhelming right now.

Ok Ipelayo, you are on the right track and I am happy to read you have closed your bank account. FL laws about internet PDL's are a little different so we will try to get someone from FL involved but first we need to know who he took loans from, how much they were for and how much you have paid them. You can do this by looking at your bank statement. You may have to look through past bank statement. Once we know who the companies are, we will know which direction to guide you.

I've printed the letter for Primnary Financial Services but I just need the address from the First Financial so I can send the ceast & desist. I'm also receiving calls from a Sims & associates 800-864-6033 who also won't give me an address.

Yes, trying to figure out who is taking out the money is difficult. Check the deposist section of your statement..see who deposited the money and see if you can match up the deposit with the deductions. Also, if there is a phone number with the entry, you can call it and work backward from there.

The Florida Consumer Financial Act requires all lenders to be licensed in the State of Florida regardless of there physical location. This excludes Credit Service Organizations who are registered here as such. None of the companies that you have listed are licensed here or are CSOs so far as I can tell. The Cashnet I am assuming is Cash Net 500 not Cash Net USA who is a CSO. Florida law puts an 18 percent usury cap on these loans and does not permit rollovers. If a PDL is not licensed in Florida the law states that the loan in not collectible. You have overpaid some if not all of these companies. Send them letters referring them the the FCFA sections 516 and 560. Also send debt validation letters to their collection agencies and make them prove that the amounts that they are trying to collect are legal in the state of Florida and also that the lenders is licensed in the state. Look up the law on the internet and send a copy along. Be sure that you do this by certified mail, return receipt. Nothing eles counts with these people.
Next file a complaint against the PDLs with the Florida Dept of Financial Services for operating without a license and violation of the states usury laws referring to the Statutes mentioned. I know that this seems to be a lot of work but it will get results. Also if any one of the CAs violates the fdcpa by not ceasing communication after receiving your certified cease and desist, or refuses to validate or threatens you with action that they can't legally take, file a complaint with the FTC. Forget the Florida Attorney Generals office. They are useless in these matters. You are better off going to the Attorney General in the states where the PDLs and Collectors reside. Please list the info going back to the beginning so we can see what youreally have paid. You may even get a couple refunds. We are all here to help you!

They have been calling my cell phone for a day or two now. I do not have a work number, I am a fulltime student and co-own a part time business.
