Ok, so I sent a DV to LVNV and the attorney, Forster, Garbus. I get a notice for a certified letter today from Forster. I suspect it might be more info about the case/account, which is fine, but I want validation from LVNV, not their attorneys....unless the attorneys are the debt collectors, which in this case Forster should be the plaintiff, and not LVNV, correct?

I can't wait to see what they are sending me. Too bad I wasn't home when the mailman came by.

By the way, there WAS a mini-miranda on the summons, but when I called the courthouse, they verified the summons and said a court date was not yet set, but I would have to answer by the end of the month. What gives with the mini miranda, if the summons is read? Why even put that on the real summons?

Ya know what i don't get Betty?? Ok, when i first got wind of an atty looking for me, 3 some odd years ago, i immediately called them and tried to settle this debt right then and there.... They refused me. Now after all these court dates, atty fees, case files and such, they get thier stupid judgement against me (my own stupid mistake) So right before we have to go to court for garnishment they decide to settle with me on the EXACT same amt i offered them the very first time i spoke to them...
U figure it out cuz i can't for the life of me!
SIGHS,
Ang

Thanks Cajun bulldog - you are always right there with the answers - and thanks for the tip. Yes, then this law firm is both a collector and an attorney for LVNV. Sounds kinda convoluted to me, but we'll see what the letter says.

Ang, you are right - the original creditor didn't want to even deal with me and I was willing to settle a year ago. Maybe they need to keep these people in business, who knows.

I'll let everyone know what the letter says when I get it.

I have been dealing with LVNV for way over a year and a half. I tried to deal with them and make a settlemen offer way back then, before I came here, and they refused. Now, if nothing else, I would have been making payments to them all this time, and they would probably have been paid off-don't understand their reasoning-if there is any!!

I still am arguing with them, and the last phone call, I told them I wouldn't be paying anymore money to them, I was tired of taking money out of our mouths and budget for a debt that is technically paid off.

Of course I have been holding my breath that they would not file suit after my snit  Good Luck to you!..KAren
