One of my IPDL's with Crown Lending was sent to Westbury Ventures for collections. I received a letter from Westbury stating that they now own the "past due $300 cash advance" They said the current balance including principal and fees is $480. I had already paid a $90 rollover fee to Crown Lending. I sent Wesbury a debt validation letter. Yesterday I received another letter from them...

So....I am assuming they are trying to pass this off as a Debt Validation. First off, they are not the "Original Creditor" and the Account # is just some number they gave my account when they received it from Crown Lending, because it is not the Account # I had for Crown. Crown Lending is in the Bahamas, so I am sure they will not be able to verify the debt. I'm not sure how to handle this from here. Should I send them another Debt Validation letter? I was thinking maybe I would just file complaints on Westbury with the BBB, FTC and my states AG, and see what happens from there. I did file complaints originally on Crown Lending, but that never went anywhere. Any advice would be greatly appreciated. Thanks! (By the way, I'm Teria, I had Vikas change my user name)


Send them another letter telling them that they have failed to vailidate under the fdcpa and to cease and desist all collection immediately or your will file a complaint with the FTC. File it anyway because they won't respond. Also tell them that there client is running an illegal lending operation in your state and that they have no legal right to collect any debt for that company. Let them prove otherwise. I am assuming that in your original letter you asked them to prove all the neccesary points regarding interest etc.

That sounds like a good idea Frog. I did ask them to prove all the neccessary points, I used a sample letter I found on this site. I'll send them a letter and file my complaints. I guess they're just trying to see if I'll fall for the BS...Thanks to this site I'm a little smarter than that! :) You would think before they purchase these debts, they would take the time to see if they can legally collect them. Thanks for your advice!

I just received this email today from my friends at Westbury....

This is a serious matter and we will take all necessary steps to recover the funds loaned to you as well as any fees that may have accrued while you were delinquent. We have attempted to get in touch with you in various ways trying to re-establish contact and work this out in good faith. We have been acknowledged only with your silence, false promises, or outright refusal at this time you leave us no option other than to begin the processes of recovery. Please touch base with me at your next earliest convenience if you would like to resolve this on a voluntary basis.



A very serious review into this matter will take place at the end of this month, at that time your account may be scheduled for further action.

So what exactly is Level 5 Delinquency? I seemed to have missed the letters for 2, 3, & 4 Delinquency!

I emailed this response to them....

First of all, I was NEVER issued a loan by Westbury Ventures. I have sent you several letters via USPS and email requesting debt validation, which your company chooses to ignore. Once you validate the debt with ALL the information requested, I would be more than happy to work with you. Until then, pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809, you must cease and desist all attempts to collect this debt. Because of your lack of cooperation in validating this debt, I have filed complaints with the Better Business Bureau, the Federal Trade Commission and the Attorney General for Wisconsin. For your convenience I have once again attached a copy of my original letter requesting debt validation.

Well, they certainly can not write. Grammar errors galore in that letter. But what to do you expect from a group of people who can not even follow instructions. And do they think you do not have the documentation verifying your correspondence with them??? Sometimes I get more angry at the fact that they take us for being really stupie more so than the harrassment. ( And i can not spell so do not hold it against me)
