Really Need Help With This Question

I received an email from one these companies today. They've changed the way they do business since the new laws concerning the interest rates they can charge the military. They are licensed in Delaware, and stated a whole bunch of Supreme Court cases that they say proves that states can't control commerce between state lines, etc etc.

They did agree, although it's a different amount, to give me a refund. It's a little over 2 grand. Here's the catch, they want my new account number, routing number, etc etc.

I really really want this refund. I'm afraid if I ask them for a check, western union, etc, they won't go for it. But I'm even more afraid to give them my new information.

I do have a savings account with 5 bucks in it at a different bank. I had a car loan with them, and they made me open up a savings account with them when I got the loan. Should I use this account? I don't have any deposits going to it, so the worst thing they could do is to take my 5 bucks out. They don't have authorization to debit the account.

Or should I just give them my new account number? What about my savings account at that bank? If I gave them that number, could they somehow get money from my checking account? The numbers are different, but only slightly.

What should I do??? I really want this refund!!!

Oh, they also said that they insist on confidentiality, that way they aren't admitting to wrong doing.


NO NO NO don't give them ANY bank info. where a used/occupied account is concerned.

I would give them the one with the $5 in it just to see what they do.

My bank has a permanent freeze on ANYTHING where UCL (who I'm dealing with) is concerned....and my bank is great so I trust them not to let any sneaky debits slip through.

Did you get this in writing? I would be very leery on giving out any account info. It wouldn't hurt to ask for a check. See what they have to say. Tell them you currently do not have an account at a bank. And if they want they can send you a money order or something. It's worth a try.

Congrats on the refund though!! That is a good amount and I would want that refund also lol.

Yeah, I hear you. When you say get it in writing, does email count? It is one of their email addresses, so they couldn't deny sending it. I really want this refund, don't want to blow this chance, but I don't want them to take anymore money from me. They want this kept confidential, or else I'd tell you the company that I'm dealing with here. Of course, I wouldn't mind telling you who I'm dealing with, but again, I don't want to blow my chances at a refund.

Hey Sub, not offended. No I am not in the coast guard sorry. Do they know that you have some sort of bank account? And save those e-mails. If you have been working with anybody on getting this company I would forward those e-mails to them also. I always forward all my e-mail to my state DFI. This way she stays informed and I have proof besides my own copies. If they don't know that you have a bank account anywhere right now then it wouldn't hurt to ask them if they would be able to send the refund to you in a different form of payment. And if they can do this then you will keep quiet about their company.

Puddle, thats what we call people in the Coast Guard. They call us squids, so I guess we're even.
No, they don't know about any bank accounts. At least not to my knowledge.
I'm going to call my bank tomorrow. I'm going to ask them what can I do about this. They're a local credit union, I've been a member for a long time and they all know me. It was one of the easiest things I've ever done (closing my account) because they were so helpful and friendly to deal with. I'm sure they can help me out. When I first changed my account, my direct deposit was sent to my old account. They had to manually transfer it to my new account. Maybe they can do that? Who knows, but I've gotta figure this out.

lol @ squids :lol: sorry :oops: I got the nickname puddlejmpr because when I got my first car it was small and people said it had to jump over the puddles in the road or it would drown :oops:

But anyway, If you feel ok with giving them that account number and you know they will watch over any transactions and you will not get any fees if this company trys to start anything, then ok. But for me I would be kind of worried about giving them any account info because of what they have done in the past. But that is your choice. I know you don't want to lose the refund and you feel that you need to go with what they want in order to get it. Good luck on this and please update us. Ok I guess I am just nosy lol I hope and I will cross everything I have that they don't screw you over again. Let us know if they really do as they say their going to.

Puddle, sounds like my first car. At least I didn't have to pay for it. Keep EVERYTHING crossed! Hahaha. I guess I just need to be patient. Thats the problem with my hours. Since we got home from sea, I'm working in a Communications Center. I work 12 hour shifts, 2 weeks of days, 2 weeks of nights, etc etc. I'm on the night schedule this period. It sucks sitting here for 12 hours trying to get things done when nothing is open! Tomorrow is Thursday, and I'm thinking that if I don't get this done, the refund won't come until next week, etc etc. I just need to slow down, catch my breath and do the right thing. I'll call my bank tomorrow, my other bank (with the small savings account) and try to figure this out.

I definitely will keep everyone updated.

Hi Volley, how are you? Not sure what would happen. In the email it says "I will authorize you to receive $2,005.94 by electronic funds transfer directly into your bank account." And, If this resolution is acceptable, please sign the acceptance statement appearing below and fax it to xxx-xxx-xxxx and I will forward your refund. Be sure to include your bank????????s name, account number, account type and ABA Routing number".

They didn't give me any other options. Number one, they want to keep this between me and them, so in order to get a refund I'll agree to that. Number two,
I'm afraid if I respond in any way other than agreeing to their terms, they'll refuse any other offers.

I really don't know what to do here. I guess I'll just have to wait until my banks open and see what they say.
Does anyone know, if this place has my savings account number, can they then make debits from my checking account? When I changed my account, I didn't touch my savings account, I only changed my checking account. It seems to me that if they were going to try to link the accounts, wouldn't they have done that already??

Sounds like you have a good head on your shoulders now. I wish you luck with the bank tomorrow and hope you get things straight so they can send you your money.

I am thinking that it is going to be hard for me to work tomorrow night with EVERYTHING crossed, but I will try :lol: oh and I know how it sucks working nights. But at least mine are not 12 hours shifts, yuck.

Hi, 'Sub'. I ,also, serve in the military...Army Reserves. The money you're talking about.....if it is from a Payday loan or from a 'bad credit' loan, becareful. Companies, like these, REALLY prey on the military. I get ALOT of " wondeful discount offers" from some of these companies. DO NOT GIVE BANK INFO OUT!! I'm sure you know how strict the military can be on 'offers' like these. Hope this helps. If you wanna chat, let me know.

sub, I know your situation. If you speak with your bank, ask them if your savings account would be linked in ANY WAY to any other accounts EVER. If the answer is no, get something from them stating this in writing. Just showing that any transactions from one account will not affect the other account. If you get this (and your bank has worked with you just fine so far), I personally would give the savings account information. I only say this because of your situation. Do not post who the pdl is on here. Talk to the bank first. Make sure they assure you nothing will be touched if these guys get your savings account number (which you would be providing to them). Once that deposit in placed in your account, go and manually withdraw it. Fast. As soon as it's deposited, take it out. Make sure you have something from the bank promising nothing will happen with your "other" account. And, yes, you're email from the pdl does "count" as something in writing. Hold on to that! Let us know how it goes. I'm just wanting you to get that overpayment back. If worse comes to worse, you can close out the savings account after you get your deposit. However, with the pdl sending you what they sent you, you might be safe regarding them. It's the fact that pdls have "sister companies" and so forth that they might share that bank account information with. This is what you have to watch out for.

I got a refund!! I used a different savings account, and they refunded me 2005.94!! Yeah!!! Those cowards, hahha, it only took one letter. Hell, it wasn't even a letter, it was just an email! They wanted to keep it between us though, because they didn't want it to look like they were admitting wrong doing! This company only gives financial loans to the military (if that doesn't give it away).

Just so you don't feel bad, I wrote down all of my payday loans, storefront and internet. I figured out what I paid and how much I will still have to pay to pay them all off. Well I was ashamed when I found out that in about 1 1/2 years I had been dealing with these payday loans I have paid over $50,000 to them :oops: Not one refund from the internet ones either. So that was a very expensive lesson. So I am glad to hear when someone gets a refund. And just keep up the fight, there is no reason to pay over what your state allows and if they are not licensed then there is no reason to pay a cent over what you borrowed.

What the hell were we all thinking? Someone should write a book based on the psychology of our thought patterns when making these terrible decisions.
There was so many good things that I could have done with the money I lost to these guys. Paying my mortgage payment comes to mind! Hahahha.

Heck sending my daughter off to school comes to mind when I see that amount :oops: That is why I am on my state so bad to change the laws here. I won't give up until they do something about it. Hell I am the poster child for payday loans in my state lol.

I only have a couple more internet loans I have to deal with and my state is handling those. I refuse to pay them any more money. I just shutter when I see another storefront open up here :evil:

All I have left is a 4 storefront loans (I say "all" like 4 isn't that many) that I'm paying off.
I have alot of internet loans, but they're not getting any more money from me. I could care less what they attempt to do. They can call me until the 2nd coming and it won't bother me. I don't mind talking to them. It's kinda fun really!

sub, good for you! You got it to where you recieved your refund without giving "real" account information! Congratulations on your refund! And, if they want to keep it "secret", that's fine. As long as you got your money back. Too bad it wasn't for the full amount, but something is better than nothing. A lot of people don't get a refund at all, even if they've paid thousands over. Oh yeah baby, you better believe I'm gonna keep at it. You wouldn't believe how easy it was getting my money back. I learned alot just from this deal. The email I received was from the owner, president, whatever you want to call it. I searched his name on here and found out he runs another company. They had his phone number (extension) so I called it. He was cool about it, but he sounded like a used car salesman. What surprised me though was that he has more than one company. I even searched that companies directory for a different employee that worked for the other company and she was listed. I didn't know these crooks ran multiple companies.

It was funny. When I called and talked to the customer rep (the email address where the refund proposal came from) she told me she didn't read his message, she just sent it for him cause his email wouldn't work. She thought I was getting a loan, and when I told her I was getting a refund she did fall out of her chair! She said she knew nothing about it (I told myself, okay, here we go), but would "look" into it. That's when I asked for the president. She said he wasn't in, so I found his number on here, called it and talked to him. He was mostly cool about it, but tried to make me feel bad for thinking his loans were causing more harm than good. He told me that it would be deposited first thing Friday morning. He kept his word, believe it or not.
