One of my friends has two hospital accounts referred to collections.
The first was handled very much like yours.
The second, well, I wish California allowed taping of calls without consent :x
Fortunately, the doctor's AR dept. erred, and the account will be pulled.

jcemt, you're right. It's always nice to deal with a collection agency that will work with you. Unlike many, many others who verbally abuse people. I'm glad that you were able to work with human beings who understand. They are the ones that make you want to bust your butt to get them paid.

FYI, I'm not saying that every CA needs to roll over, but they should try to approach each case with some compassion and humanity, try to help the debtors while at the same time performing successful business. There are two extremes with CA which I have noticed, there's ACE adjustments, then there are CA's that are pay us now or we'll have you arrested, sue you, garnish your wages, take everything from you, break your legs and do ungodly things to your farm animals... Right in the middle is: I want the money in full, I might be able to cut you one or two deals, but if you can't pay thats tough, because I don't care about you, I just want this account paid.
They need to obey the law, and at the same time try to handle things in a more humane manner. When a collection agency calls a debtor they have no idea what is going on in that persons life. They may have fallen on hard times, maybe on STD/LTD. Just calling someone up and saying pay me and being hardcore about it isn't always the best method. The biggest thing that collection agencies need to realize (and I would say the best legit ones do) is that they have two customer types, the creditors hire them, or sell the account to them, but their overall performance determines if they are hired again in the future, or if they get paid by the debtor.

   Strangely there are still some good collectors out in the world. My personal experiences almost duplicate morningstar. One was nice and did her job professionally and the other was garbage. The collector who was nice got paid within a week of phone call and no rat litterings went on my report.

I am also glad that there are seemingly decent debt collectors offering opinions on this sight-- however anytime one of them says quote "you should pay debt even if it has been charged off and 15 years old you still owe debt" I'm thinking WHAT? two words --Bud Hibbs! check it out-thank you!

Cajun--some of my best customers and friends are debt collectors --but they are collecting past due student loans --a huge business which is down the street from me-- collects huge debts owed from free education -- and I am friends with many of these people--this company employs 3 shifts--the place never closes down okay? I would guess I am friends with about 1,500 of these employees from personally dealing with them in past ten years --collectors are not bad people--it only gets bad when the methods they use are wrong! So guess what? I bet I have more collector friends than ya'll ever had! Difference is the people I know do things the right way with respect and following the law !!

I've never dealt with debt collectors, but I'm sure I wouldn't like to. Well, take that back, I'm currently dealing with one, but it was for an illegal loan, and the CA isn't even licensed in my state. They're gonna give me a hard time? Please. I hope they try to take me to court for this. I'm sure they're cowards, so they'll probably eventually give up. As far as I'm concerned, they're part of the problem and not part of the solution.
Personally, I don't believe that companies should be able to sell off to send off their debts. They should have to deal with them themselves. I think this would prevent a ton of problems associated with debt collection. I do say that people should be responsible for their debt. I do agree with that. But let the debtors handle it. If a company can't handle debt collection, then they shouldn't be in business.
I'm sure someone will disagree, doesn't matter. I'd outlaw everyone of them if I could.
I will never, as long as I live, deal with a collection agency. They can call till their blue in the face. They can call my work, family, friends, be nice, be mean, follow the law, threaten me, play good cop, bad cap, doesn't matter. I won't deal with them. I'd rather take my chances in court. At least I'd assume until proven otherwise that I'd get treated fairly. And that whatever happened, it was fair and just. I'd assume that the judge would follow the law without bias, etc. If I lost, oh well, at least it was fair.
As a matter of fact, I'm sending a DV letter on Monday. Certified mail. I'm not asking for, but demanding, a refund on the cost of the mailing. I know it's not going to work, but this is how strongly I feel about this. I'm gonna bug them for awhile until they give in or I get tired of the game. It's not my problem they took a gamble without knowing who the players are. They bought an illegal loan, their bust. I tried to make arrangements, but the pdl place wouldn't budge. Really stupid move. The CA said I could make payment arrangements. Hahhaha. Okay, I'm gonna tell them they can send me a quarter a month until they're paid up. I'm a nice guy, they can take as long as they need to take care of this.
Anyway, I feel strongly about this type of business. I don't want to offend anyone, just wanted to speak my mind.

I will forever maintain that people should pay for things they took. It's the way I was raised. It might take a person a long time to get something taken care of. The leading causes of debt is illness, death and loss of employment. It does take time for people who aren't prepared for such things to recover. When the recovery is made I do believe that debts that were created should be honored.
Everyone is entitled to their own opinon about this. I am open minded enough to accept that, are you? I hope so and I would appreciate it, Hanky, if you would jump off of my back. You've made enough unfavorable insinuations about my character in several different threads and I would appreciate it very much if you would knock it off. I normaly don't respond to such nonsense because it is usualy posted by someone trying to hide who they are. However you aren't. This will be the only and last time I will discuss it either.

I have dealt with several collectors that have been really helpful and good to me. They were debts that I did owe-hospital bills, and they worked out a payment plan. My son that is on disability has been working with one-or rather I am, and they are really nice and helpfull.
I know debt collectors too,not going into a contest with any one who knows the most, and they are really good people doing their job.
FYI has been a great help to me and many others here, having been on both sides of the fence herself, in understanding some things about collectors and agencies.
I have also dealt with some CA that are monsters. Trying to collect on debts past the SOL-which, btw, I had paid, etc.
I fot myself in debt-no one else. I took out loans,cc,etc., and used the money-no one else. I am trying to make my life better today by taking responsibility for what mess I have gotten myself into and paying off what I took. Yes, I did use the money for necessities, but I still used it.
I don't believe in collectors breaking the laws, etc. The last one I am dealing with is horrible-but I know my rights today and am dealing with it. I also have paid way more than my cc balance. I had a $780. credit limit and paid stupidly for over 20 years to the tune of over 13,000 dollars- I believe it is paid.!
Not all collectors are bad, just as not all lawyers, policemen, car sales men are bad..just my opinion.karen

I to am digging myself out of my hole that I got myself in, almost paid everything off (about 3-4k left) I'm in the process of dealing with a couple CA's waiting to get validation before I start paying them. For the most part (except for CACH, LVNV, and NCO) my interaction has been: "can I get validation on that so I can get this taken care of?" "ok, we'll fax it to you and/or mail it to you" once I get the validation back, it's on, try to get it knocked out ASAP then on to the next. I've almost got everything straightened out except for the fight that the previous 3 CA's have been putting up.

Granny, that is so funny! LOL! Or you could say you moved to a different state or something.
Seriously, I have dealt with both rude and nice CA's, and all the rude CA's did was make me angry. I realize that everyone has a job, but I also think that there is a certain amount of common courtesy that needs utilized when talking to someone about sensitive issues. There are some CA's out there who do a great job at collecting. They are courteous but firm, and they offer options, not threats. AND they don't do things like hang up on or yell at you. That accomplishes nothing. I don't think that a CA should let someone get away with running over them (then they wouldn't be doing their job), but I do think that they should be respectful of those they are collecting from.

Sub I love the post you made and will be checking out all your posts! But FYI __ As for your comments towards me -- I am sorry I don't trust a debt collectors true intentions' for being on this sight-you answered one of the first posts I made upon registering and I responded to your comments and then started looking into your posts--I think we should agree to disagree--I'm not on your back--and never have been-- I just don't trust the way many people in your profession act--and why is what I say nonsense because someone simply questions your opinions? I thought this was an open forum? I was actually the one who originally felt I was attacked because I questioned your motives after someone else slammed you regarding your depression and monetary gains for being here --and you are friends with other moderator's on sight and I find it very strange that you are now questioning my motives and addressing me personally --I came to this sight because a debt collection co treated me very badly about a debt I did not owe-- and then I started researching the debt collection process--FYI I am not on your back--I just disagree with most of your opinions --and that is my right to do so on an open forum such as this and you have right to respond accordingly--if others here want to attack me --that's fine too-I am just here to question the antic's that CA's are in my opinion unbelievably getting away with here in America--your opinion is that people should pay for things they "took" like everyone who doesn't pay their debts are a bunch of thieves or something--I have seen statistics that a big percentage of debt collector's are also in a ton of debt themselves--people get in financial trouble or are victims of identity fraud daily--the original debtor should be the one who collects these debts--that is only my opinion--and maybe it is wrong--in the business I have worked in for all these years--if someone doesn't pay the debt they have agreed to--the local district attorney's office handles it--my opinion--these matters should never have to be passed on to someone else -my company decided that if DA has been unsuccessful to collect said debt they subsequently write the debt off rather than turning over to CA because they don't want to be responsible for violations of fdcpa and more losses that may incur --and FYI I am not on your back because I disagree with your opinions and because I am not your buddy on this sight!!!-please do not feel offended because I disagree with you--it doesn't mean I don't like you--it simply means that I don't agree with your opinions FYI even though I have previously stated that you seem to have helped others on this sight- I still feel your commission at your work is your main priority and is ultimately what forms your opinions and advice on this sight(it's like Jury duty that I have served on 5 times now --you say you can observe without prejudice but when it gets down to deliberations deciding someone's fate-- those locked in life long opinions are not going away) and I could be wrong about your motives-- but I am entitled to that opinion! I'm glad you have friends who respect you here--but I don't know you--you aren't my friend--it's not a personal attack--I just abhor the industry you represent and that's not a personal attack because I question your comments okay? And my direct question to you is why is it nonsense that I have disagreed with you? NONSENSE In your opinion of course! :o FYI I'm not into creating DRAMA and hope this will be the end of our personal one- on- one! :D
