Does anyone know how SOL's work? Each state is different, and what I need to know is how I determine the SOL that pertains to my debt? I now live in Ohio, but all my old debts originated in my home state of California. SOOOOOO, does the SOL pertain to:
1. State of residence when the debt occurred?
2. State of residence when the collection agency bought the debt?
3. State of residence when the collection agency first contacts me?

Im not gonna BS you guys. Yes i am one of the "Bad Guys" if you will. Im not gonna tell you that ""this attorney is really a good person, you should work with him"...."what i will say is this what do you seriously have to lose by calling i have ppl calling me too its all an endless cycle i try to do what i can when i can but not all DC's are bad ppl and not all Debtor's are angels, its like anything else a few bad ones ruin it for everybody else.

And as for your "it's the debtor that sets the tone of the phone call" argument? Please!!! I can play several recorded calls I have had with CA's where they set the tone of the call from the start, and it was far from "nice." That's why I only deal with CA's by mail; I just don't need the headache!
Oh and before you set in on what a deadbeat I am, please note I got behind on my bills because I was unemployed for over a year-and-a-half for medical reasons. So save your "one size fits all" definition that all debtors are deadbeats that just don't want to pay their bills. Sometimes circumstances really are out of a person's control.
So go on back to work at Mr. Cignarale's office and stop posting your garbage here, because we're not interested.

If you do pay your debtr then issues like these would not occur. And for your info I do not work there. I Actually have a Degree in childhood education who knows I could be teaching your children!! I am allowed to state my opinions just like you do. So shoot me if I think the economy is going to s*** because the low lives out there can't pay their bills. ( I do understand circumstances come up, but lets be real alot of people abuse the system!! )

I was sent a few letter and received a few telephone calls last october and in the end my husband got so fed up we paid Vincent P. Cignarale $800 settlement figure for a debt that had now totalled $2,250.12. It was orginally $1,245 so when Mr. Lennard said we could pay it off for a total of $800 we agreed and paid using a visa card.
Now yesterday 26th april 09 i have another company sayin i still owe the full amount and they need proof i paid they are being very rude they call 10 times a day.
I have telephone the Law office and the number is invalid now and i cant reach anyone at Unistates Credit Agency that my husband paid. Help what do i do now will i get the $800 back from credit card company? Is this a fraud collection.

i hope you learned something from this.never pay anything by any other way but money order after an agreement is reached in writing.if you still have the letter file AG and FTC complaints.don't know about getting the 800.00 back,but just remember.get everything in writing before paying,and i mean everything.

You must write the payday loan companies and tell them to stop calling and all contact must be in writing. Also, fill out a complaint form on the Federal Trade Commisson site. The payday loan consolidation companies charge alot of fees but do work for some but not all. Others will turn them over to companies like Vincent P Cagnarale. Payday loans for much states are illegal contracts so no matter what anyone tells you, they are not enforceable however, there collection techiques are a real hassle and pain, Bottom line, do not use any payday loan. Beg, borrow right up to steal before you use them.
Payday loan companie that will not settle and use blood hounds like Vincent Cagnarale, Maguam Payday-triples you amount owed and will send to credit bureua-you can get if off, but it requires phone calls and letters. SonicPayday - will not settle and is very rude to talk to when you in over your head.
Companies that will take a settlement - 1800899Cash, Cashnetusa, the one from the Indian Reservation -uses alot of different names.

I took mine out with ACE and they just called me and sent me verification of the debt i have with them and that this guy is a scam and they can't legally sue you. They are working on this and getting this guy shut down. I just have to send them the caller id info and the name that shows up on my bank statement for the charge. AGAIN DO NOT PAY it is a complete scam!!!!!

I owed Cashnet USA and showed them the letter in case i need another payday loan and sent in the letter to the CRAs to took get my tradelines updated. I am all in to stopping FDCPA violations but to encourage people not to pay their bills and to pay the original creditor when they sold the debt to a third-party is just plain foolish. You cant play that game with the banks when they sell your mortgage to another bank and you cant do that here. Pay your bills to the right person and get a paid letter!!!! get out of debt its the way to go.

Also returned a call to the "guy" that called me at work and everywhere else and let him know the office was in violation of the FDCPA and gave them the #'s they were in violation of. If you get calls file a complaint so the FTC can stop these people.

I set up a payment plan with the scam artists just this week. But fortunately, I got a call from another set of scam artists companies that made me take a closer look. At any rate, this is a scam. What they are calling me on is from 2007 and not even on my credit report. They do not have my current address and have not sent me a thing in written form to verify anything. I went to my bank, closed "not really" the one account and opened another. We are going to leave the account open that the law office has and see if they try and extract money from me. I have called over and over again and no one ever answers the phone or will call me back. They too, threatened me with legal action, being arrested, etc. I filed a report with the FTC today and am filing a local police report for fraud and taking all the information to my bank to keep my credit with those folks intact. Bad things happen to all of us and sometimes we cannot pay all of our debts when and how we should. That does not mean that we are crooks. I have called the people I owe directly and if they have sold the debt to another agency, then they will give you that information and you can contact them directly and set up payment plans with them. Do not ever set up payment plans with these idiots that call you out of the blue and never send a letter or tell you they have tried to go to your house and serve you. Most of them, when pressed, will either hang up on you or cannot even verify the county in which they will need to file court documents in. And if they insist they have filed a court case, get the doc number and call the courts yourself. Guess what folks, no cases have ever been filed on me when I have been told that someone is standing outside my house waiting to arrest me or I am going to go to court and lose everything I own over 700.00 worth of supposed debt I owe that I cannot even verify is mine to begin with.

People dont try to avoid their debts-they are just tired of rude disgusting illegal collectors calling and harrassing them, when 9 out of 10 times-the debt has already been paid, or its an out right scam for you to take your exotic little vacations on and to buy your latest drug addiction with. Why dont you get a clue what real life is and go elsewhere with your crap

A friend of mine received a phone call from this company yesterday, he took down their info and said he would check into it because he doesn't remember incurring the debt. He told me about it, so I called them. Keep in mind I work for an attorney's collection agency also, but mine actually follows the law. When I called, no one read me the mini-miranda nor was it on the recording when you call into the office. I told them what file I was calling in regards to and offered to give the info on the person who probably incurred the debt. Mr. Porter asked who I was and I told him I was a friend. I told him, that my friend never had a bank account and asked what this was all about. He told me everything which means he third partied...my friend did not give him permission to tell any details of the account but he did anyway. He proceeded to tell my friend that he would sue him...I asked for validation of the debt...he faxed me a "demand letter" and not validation. Mr. Porter then proceeded to call my cell phone 2x today, and called my friend's cell phone quite a few times which is another violation of the FDCPA. Let's just say I think "Mr. Porter" realizes he messed up and that my friend will not have to pay whatever they claim this debt is about.

I take payments. and I get crap for it. I do enjoy one "coworker" who loses her mind every time she calls a wrong number. She yells scream and threatens and it is a wrong number. I read a post on another site about a person not the debtor who called in to have his name taken off the list...the collector lost their mind...as I was reading this post all I could think of was my coworker....I am in collections and all i have to say is if you are being called, harrassed whatever..learn the Laws and use them to your advantage, but if you owe a debt pay it....dont be bullied but pay the debt you owe

So this company has left tons of meesages on y cell, on my work voice mail, and now have begun calling a home that I haven't lived in for 20 years but have a distant relative living there. I want to know exactly what to say the next time they call so they will stop calling. I intend to ask for a validation letter and I also want to tell them to stop all phone calls. Has anyone had any success with this?? I can't afford to hire a lawyer to go after them so I need to know what to say to them and then what to do if they continue.

My ex husband is a bill collector here at this "phony" law office. I find it amusing that he doesn't even pay child support for his own child. What a loser!! He goes by the last name of Hess....if he ever calls ...ask him when he will start taking care of his own kids...
