What to do

I'm in about 40k worth of debt, however 17k is a car loan (which has been accelerated, though I still have the car, I'm sure it'll get repoed soon) and about 13k in student loans (which are in deferment because I'm in school) and I have about 10k in credit cards, installment loans, and payday loans... about 10 different accounts. Its all my own fault I know, and shockingly it only took me about 3 years to get into this hot mess (I'm 22), I've learned my lesson. But now I just need to know how to fix this. Should I just declare chapter 7 as I have no assets or income? or should I try a credit counsiling service? and what can I do with the car if I just try to pay it all back over a time period? First of all glad to hear that you are in school and that your loans are deferred, that will be one less thing on your mind. i believe once you get out of school your loans will be in a grace period (about 6 months depending on your loan) and that will give you some breathing room to find a way to make your monthly payments.
I can only speak from experience on the credit counseling issue, please talk to a debt professional on this forum though to find out if this option is right for you.
With 10k in consumer debt you should be eligible for debt consolidation. Should you choose this route be sure to check with the Better Business Bureau website to see if they are a legit company. then there are some questions you should have for them
1) How much is their monthly fee (if they have one) I had a non profit that charged $30 a month which is fair considering I had the same amount of consumer debt that you do now. When you are given an estimate from your credit counseling company they will include this monthly fee into your monthly payment.
2) Go online and see if you can't get some testimonials on others that are currently using your organization of choice. I was with Ameridebt at the time and they dissolved because of shady business practices. Another company took them over and while it did not affect my payment plan, it could have.
If you choose wisely, your collection calls will stop and chances are your over the limit fees and interest (if you have over the limit issues) will stop and you can ACTUALLY start paying the principal money you owe to your creditors. I strongly advocate CC just be careful who you choose.
Now, cars I don't believe can be included on CC, so right now try and focus on remaining current on your car because you need transportation :)
When I chose credit counseling I had no assets or income either. my parents had to help me and I was your age at the time. You will get through this, this forum is so awesome and this site will help you so much. good luck to you, you will be ok!
