Need help Quick - Court for Default Judgement in 2 hours
Date: Wed, 10/17/2007 - 05:46
Well, a bottom feeder law firm has picked up my Harley Davidson Credit, Love-Beal & Nixon, (on a volunteer repossed bike 2 years ago) and has won a default judgement. They served the summons to my co-worker while I was out of the state for two weeks and she did not tell me until it was too late. I have asked for a hearing due to hardship (husband is not working and only my income coming in) and meritourous defense. I was also involved in a very tedious trial for a different reason during the time of the summons service, which has since been resolved. I am claiming bankrupcty (submitting the filing fee this week). What can I do today that will help me today until the filing. They were already awarded a default judgement which my company has responded to ($278 every two weeks - can not afford this at all, especially for an item I no longer have). Thank you very much.

This is interesting post! I think u may have been able to vacate due to imporper service... not sure that's possible now since u've started paying on it. All i can tell u is court is a very scary place and is very intimidating! But take a deep breath and things will be ok. I went a few months ago and it wasn't bad at all.... I worked myself up so much and they were all very nice and understanding.
Please let us know how it goes after,
Ang

As soon as you file for BK the garnishment will stop.
Even if you don't have all the money to pay the filing fee for the BK, you can submit a form to pay in installments. I believe it's as little as $50 down, and with that the garnishment will stop.
