Something Doesnt Add Up With ProCollect On My CR
Date: Fri, 10/19/2007 - 09:37
To make it short, I lived in an apartment complex starting in April 2005. The place was crap and I had to get out, so I moved out in October 2005 (half way through a year long lease - 6 months out of the 12 paid). Needless to say the apartment manager went back on a verbal agreement she and I had and sent the balance due into collections. I got a letter in January 2006 from ProCollect, and I ended up working out payment arrangement to send them $100 a month until August 2007, when the account would be paid in full.
Things happened, I became unemployed and such, and I fell behind. The balance left is $675, and hasn't been paid since February or January 2007. Some things don't add up, though.
On my Equifax report it says that my account was first delinquent in April 2005, which is impossible since I lived in the apartment complex from April 2005 until October. I can't be delinquent if I'm paying rent. Second, it says the original amount owed was $2,334. If I started paying in Jan 06 and was supposed to end in August 07, that is 20 months. That's $2000, not $2334.
I still owe them $675, which some of that is fees and stuff I'm guessing.
ProCollect is brtual, I don't know how to deal.
Any advice?

I guess I should also ask, would sending a DV letter do any good since I already started paying on it almost 2 years ago? Or would that be just a waste of time?

Well, I don't know if it is a bad idea...it couldn't hurt. Make sure you ask them for detailed information as to how they come up with their figures. You may have to dispute it with the credit bureau for inaccurate reporting. Hopefully someone else will be along shortly who can provide more insight into the DV letter.

I think that is a good idea eleroo. I personally think that they should give you validated information on it, and I would defintately dispute it with a dv letter. I don't think that it should matter that you started paying on it but I could mistaken.

I don't think it matters, either. It seems that they should always have to validate the debt. Or at least where they get their figures so that they can show they aren't overcharging you.

If the original agreement was a of a verbal nature (hence nothing in writing) they cannot charge interest or additional charges based on a written agreement (as there is none) therefor if they would decide to sue you on those grounds then anything they state would be hearsay. I would request validation of this debt including a requested explanation of charges and how they had arrived at the total that they are presenting.

So then I am able to send a DV even though I've paid most of this off? I haven't paid it in awhile.. I just want to make sure I don't send the letter out and they think I'm trying to get out of attempting to pay the rest of what's left.

It's just as Eleroo stated, make sure they aren't overcharging you. At the very least from where you stated that the date of first delinquency was 4/05 it appears that the account has been reaged possibly in a attempt to access further interest on unpaid debt as permissible by federal/state law.
Does anyone have a sample DV I can use? I'm not a fan of the one
Does anyone have a sample DV I can use? I'm not a fan of the one in the DIY section, and I saw an excellent one posted by somebody in a thread but I can't seem to located it. Any help?
