Converting CH 13 to 7 post-divorce

I am half way through a 5 yr total repayment plan. I got divorced a year ago. Since that time I have been off work with a back injury, begging and borrowing from family/friends. I am finally better and employed, but still cannot swing a 650.00/mo payment. I am wondering if we can discharge the 13 by non-payment, and then just I (instead of both of us)file a CH 7 for the remaining debt? Its frustrating, as many know, to try to do the "right" thing by repaying, but be unable to support a family and do so! I appreciate any help you may be able to provide. Thanks!

No, I do not think missing a payment on your 13 will help you get a 7. I had a 13 a while back and I had the choice to switch to a 7 and I did just that. I was not behind on any of the 13 payments when I did this. I would not miss any payments for it will bite you and bite you hard. Talk to your circuit clerk or attorney or both that did your chapter 13 and see what your options are, but do not miss a payment, not now.
