Found this board last night while surfing....this is indeed a unique board.... Glad I found it!!


Well, I was researching the dreadful collection agency named CACH up in Denver....and Joe Pezzuto here in Arizona...

Long story short... CACH took my alledged debt through NAF, while I was kicking and screaming as well as not agreeing to it... The outcome was in favor for them of course..

The Law Office of Joe Pezzuto has taken the "case"...I'm just trying to figure out whats the best route...to get rid of these clowns....

I'm not really familiar with CACH, but I have seen it posted here many, many times. Have you searched for it within this site? If not, just go to the search box at the top and type in whatever you want to search. Also, someone will probably be along soon who has had some experience with them. We have lots of knowlegable people on the forum, so just hang out. Someone will be along soon who can help you more. :-)

fdxguynzona, have you sent them a debt validation letter yet? Collect America is for the most part a junk debt buyer. The original creditor usually no longer has the information on the account meaning that CA/CACH probably won't be able to validate as they usually don't receive much information on these bulk portfolios in the first place.

well I already ihave done the DV twice..they ignore it both times... they ran me through the NAF...I denied and refused I ever agreed to go to Arbitration EVER... now they handed it to one of there clowns who doing his best to get money out of me... I am in the process of filing a complaint with Attorney General, BBB and FTC and the AZ bar...

they are the worst...to say the least

If you have sent them a validation request then they must cease all collection activity until they can produce said validation. This includes legal action/arbitration. Is NAF National Arbitration Forum? If so I think there might be some conflicting interest issues there if I remember correctly.

From what I have read, partly on Bud Hibbs's website as well as a few other sources it appears to me that the arbitration is almost a scam. Allegedly JDB's will come to NAF producing computer generated fluff to try to win the case, when they actually have to provide original documents from the original creditor. As in the case of junk debt buyers and certain other CA's (mainly JDBs) they don't have the proper documentation to back up their claims as it has probably been expunged from the original creditor's systems. However you should not ignore a summons to arbitration as it could lead to a actual judgment against you. So in short you may want to have a attorney on retain/standby just in case.

Arbitration is a scam.... its the last life line these clowns have....

IMHO....A person has to stay up on them...and not fall asleep...they will run over a person if they are not on their toes...

There is a site that is trying to bring attention to this arbitration mess... I will have to find it...

But, if people dont stand up and start making more noise... this will continue... and good people will be ruined in the process
