break, do you have bank statements documenting the debits they have taken? Or have you not paid on this one yet? If they have debited your account, thier debits will show up on there. Proof of payment. And as far as the "returned charges", they know where they can stick them.
No I haven't paid on this one apparently. And no I don't pick up

Everytime the call you, email them the letter over and over.....and in your email along with the letter, also say that " You just called me again at (time) and this is being added as a log of your calls after I sent you the cease and desist letter"

So...what I need and I know I'm getting annoying, but in my state, when it says prohibited, what does that mean? Am I responsible for paying the extra fees? Can they sue me?
reply
You are NOT annoying! Lord, that's what we're here for! To help you! Your state is New Jersey, of which payday loans are prohibited. Not allowed. No internet loans. No storefront loans. None. These internet pdls can not sue you, send you to jail, or do horrible things to your children or pets! They are just flat out illegal in your state. These pdls should not even be lending to residents in your state.
So should I not pay them at all or soley what was lent to me?

break, simply put, it's entirely up to you. Honestly, this question comes up a lot. Since pdls are prohibited in your state, you can legally not pay them a thing. They can not legally collect on the debt. It was an illegal transaction. However, on the flip side, the majority of people pay the principle amount of the loan, as they did receive the funds and they did use the funds. So, actually, it's your decision. You can chose not to pay a darn thing and they will harrass you until the cows come home. Or you can pay the principle, but they'll still be unhappy because they want a million dollars more than just the principle. Either way, the pdls are not happy. So, it's your call. Whichever you decide to do, just make sure that you file complaints on all of these pdls, as they are lending illegally in your state. File the complaints. Pay the principle if you feel it is morally the correct thing to do. Don't pay a dime if it just kills you that it's an illegal company. There is no right or wrong answer here. It is up to you as an individual as to what avenue you take. And you will not be judged at all for whichever way you decide to go. Not here anyway.

You ned to file complaints with the BBB, the FTC, and your state AG. And, no, they will not sue you. They are illegal. Can you just picture them coming to your state (that prohibits payday lending) and taking you to court? Oh Lord. Now that would be something worth watching!
LOL...I,like many others, are just being paranoid.

No, no! You have every right to be paranoid! I am paranoid as all hell! I was waiting for police to show up on my doorstep! No lie! Don't worry about being paranoid. Take my state for example, storefronts are legal. Internet lending is not. Now, I was freaking out because I thought "legal" meant "legal". After contacting my state DFI, I found out that internet lending is illegal and the debt is uncollectable. Now in your case, you're safe all around because payday lending is illegal in your state all the way around!

No paranoia at all!! All good questions and you need to feel comfortable about all this....its crazy!
as cannr mentioned, an illegal company will not rear their head in a LEGAL court venue and what leverage will they have??? They lent to you when they werent allowed by law....period.

momma, it will depend on your state laws. If you would like us to look at your information so we can help you please list the state you are in, and the pdl companies you borrowed from, how much you borrowed and the total of how much you have paid to each. Also, when you post this information would you start a new thread so it will be easier for us to find you. There are so many people here who have been where you are and we do what we can to help.

sorry ripped, but ipdl's are always dictated by the state laws of the borrower.since most of these companies are not licensed therefore not legal, how does wanting to pay back the principal only make anybody here bad.being an adult also requires making an ounce of sense you didn't sorry.

That is not necessarily true - Most states have "long arm" statutes, that allow it to govern any business done in it's state. But not all state's have these laws, and in those state's it would be the state the business is located in that would govern the transaction.

A reality show regarding pdls. Holy crap! Now there's a million dollar idea! Put this crap you have to go through regarding pdls, the daily life of living it, the ups and downs, the good days and bad days, it would be friggin AWESOME!!!! No one would ever take a pdl out again! Although, I have to say, they would have to "beep" out half the words on the show because you can't live this without swearing like a sailor!
