Ok, I'm located in the state of Ohio and I have this one storefront payday lender a thorn in my rear. I am currently with Town and Country and this one place filed a suit against me in small claims court. I have a signed proposal from him to Town and Country but now he's adding more fees (T&C is calling tomorrow to find out on the added fees). I know for sure they have added court cost to the amount owed and I don't fell like I should pay it. What happened is this, Town and Country screwed up the first month and sent 24 dollars to them (was to be 100). Instead of calling me or letting me know of this error he runs to the court house and files a small claim. I noticed on Ohio laws it states 20 dollars for collections and court cost (am I'm correct on understanding Ohio laws?). Should I just pay the court fees to make him go away or just paying what I owed from the contract plus the NSF fee. I just don't want no judgment to show up on my credit report. If this goes to small claims and he wins, will that put a judgment on my credit report? Or if the store wins, can I pay the court clerk as soon as the hearing is over to avoid a judgment? I also guess when T&C call me tomorrow this may make up my mind better. I took out a $400 dollar loan with this company which would be due $460. Somehow he's saying I owe $590.


If this goes to small claims and they win yes there will be a judgment on your credit report. Even if you pay right away. And it stays on your report for quite a few years. I would have t&c contact this company asap and tell them of thier mistake and then tell t&c that they should fix the mistake they made and if you get any extra fees tacked on to your account that they will have to pay for those, since it was not your fault. I would be on t&c until they get it fixed, I also would contact the storefront and let them know that it was a mistake and if he still wants to take you to court I would call the district manager and keep going up from there. But t&c should take care of this. But keep an eye on the storefront it sounds like they are just trying to get a few extra dollars from you.
