Wage Assignment - Sonic Payday

A friend of mine has a huge problem. She has a loan with Sonic Payday. A company I am well familiar with. She stopped pay on her loan of $600.00 and she sent a letter revoking any wage assignment, filed a complaint with the DFI of Arizona and the Attorney General's office. The problem is that she sent the revocation by e-mail to Sonic Payday and did not fax it to them. She cannot find the e-mail but has notes where she spoke with a collection coordinator with E-Care Service who advised her that she did not have a wage assingment on file for her. In any event, she called me this afternoon to advise that Sonic sent a wage assignment to her employer but for only half of the debit. The company usually does several debits each payday. Question, since the wage assignment was for only half of the 600 she owed, she spoke with her administrator and the administrator told her that she will most likely not honor the wage assignment but encouraged her to send another letter to the company, this time by facsimile revoking any wage assignments she may have agreed to, just in case Sonic sends another wage assingment for the remainder of the loan. My question is, when they sent the wage assignment for only half of what she owes, does that mean she still can revoke the wage assignment for the remaining amount. She is a littled confused and my issue with this company was resolved without any issues. So I turn to the forum for advice. Thanks.


Update and good news. The wage assignment issue has been resolved. The firm is not going through with the assignment, which made my friend very happy. Thank goodness the wage and hour attorney resolved the issue. It is voluntary and the company does not have to honor it. In this case, the HR dept. was wrong in their holding back the wages. So sometimes there is a positive end to a bad situation. My friend is very happy. Once again, thank all of you for your help with this siutation and I have encourage my co-worker to join this forum as it has been a wealth of knowledge for me.

I am on the site regularly. I actually have sucessfully used this information from this site and from my work experience to deal with One Click Cash. Evidently my complaint to the DFI of Nebraska was the straw that broke the camel's back and the issued a Cease and Desist on this company. The hearing is set for October 29th and I cannot wait to find out the ruling. Hopefully it is a favorable one for the consumers who have been screwed by this company. Once again, thanks for your help and will definitely be around the forum.

BTW, as HR people we receive constant and current training. We have to! Laws change constantly, and violations of Federal policies are costly. There is no HR rep who doesn't know what a wage assignment is, I'm sorry. They are nothing new. They have been used by sub-prime lenders and high rate credit cards for years.

ctr, thank you for posting that! And I'm so glad for your friend! My gosh! I think we were all in an uproar over that ordeal! Your wage and hour attorney needs to be thanked also! And your HR person needs to be smacked! Sorry. Thank God this is a happy ending. Others haven't been. I know you'll be around, ctr! You've been for awhile now! I love to hear from you! :D

To all and Cannr, thank you for your advice. Now just to give you heads up. All those battling One Click Cash, the hearing concerning the cease and desist filed by Nebraska DFI is scheduled for Monday, October, 29th. Evidently One Click Cash is fighting the cease and desist order. So we need to pray very hard that they are shot down. This cease and desist order is out of the State that One Click Cash says they are licensed to conduct business and are binding all invidividuals who take out loans from them to the laws of Nebraska. We all know that to be wrong as this company only abides by the laws accoridng to MTE and One Click Cash. I will put another thread up as soon as I receive work on the ruling. My complaint is one of the very last ones before the Nebraska DFI filed a Cease and Desist Order and it helps not just the residenst of nebraska but all consumers' regardless of what state they are in.

Oh, thanks for posting that! I'll be looking for that thread you start! One Click Cash never responded to the BBB complaints or my FOUR letters from my state AG. Just totally blew them off. So, there they sit. Good for nothing's. Please keep us updated on this one, ctr!

Do so because I know that the gentleman over at the DFI of Nebraska was still accepting complaints against this company. I have not heard as of yet the ruling from the hearing that was heard this morning at 9:30 a.m. I was going to give it a day before I called to find our the status of the ruling in that hearing with One Click Cash.

This really scares me. I was thinking of asking sonic to accept half a payment this month, but I'm paying the whole amount even if I starve the rest of the month. I just want to be rid of them. Goood luck, I hope it all works out.
