I thought I would share this experience hoping maybe it would encourage others when dealing with a collection agency......
A collection agency was calling me several times a week and I decided I was going to hold them accountable for their actions since I had sent a letter requesting validation of debt which included a cease and desist on phone calls, etc. When I called they told me they were recording and I agreed and stated I was recording the conversation as well. I explained my situtaion regarding the dv letter and phone calls and explained that I could prove they received the letter and on what date and I could also prove they continued to call and were in violation of the law. I also said I had called on (i gave the date) and tried to explain my situation, to which I was told by their employee that becuase I did not send a letter to the attention of any one person, they did not have to honor it. THe young lady then sent my call to her supervisor who in turn recapped my discussion with the first girl and proceeded to admit they did not handle the account correctly. I told the supervisor that I had filed complaints on the company with the FTC, BBB, AG and their State Bank Commisioner and once I did this the calls increased from 2 - 3 per week to 3,4,or5 a day and that I considered this harrassment and I could also prove the increase in calls following my complaints. She said I would be placed on cease and desist and there would be no more phone calls and wished me a good day and hung up.
I was on the verge of changing my phone number because of this and for some reason decided to take action...I was tired of it all. Documentation does pay off. So many of you have given me advice regarding this and other situations, I wanted you all to see your results. Thank You all.
