This website is very disturbing as it is a database that lists by state what debtors they have on file as well as other information, here is an example from the website. If I select Colorado and select the name Mary Williams it comes up with this:
Business Name:
Colorado Telephone Inc.
Responsible Party:
Mary Williams
Address:
3000 S. Jamaica Ct Ste 340
City: Aurora
State:
Colorado
Zip Code: 80014
Amount Owed:
$4,165.00
Date of Default: 9/29/2004
Resolved?
No
Date Resolved: 0000-00-00
Someone is posting the names of debtors in a public place as well is the persons address, how much they owe and whom they owe it to. This has got to be a major fdcpa violation. Not only for that but that would allow any JDB to just pick up the info from that site and try to collect on it even if they have no right to do so. Who should this be reported to? FTC perhaps? Also I think some people on that list need to be called.

Wow! that is scary finsfan! I think it ranks right up there with you googling in your phone number, finding the address of your house, and then using a site to find out exactly where your home is! the internet can be a wonderful thing and it can be scary too. I'm not sure who this should be reported to. I would imagine the FTC certainly should be involved

Finsfan as I thought about these people's names being posted on this site..I realize that if any of those being posted filed bankruptcy and the person who posted their name was included in filings...that debt was written off...no longer owed to them. The only request on this site was to pay 45 dollars then you could post anybody's name that owed you. You're right..this site needs to be shut-down.

They also arent a CRA, so this site could well be exposed to suits for liable.
However, I dont think most collectors woudl go to he extra expense to to pay the REQUIRED $45 fee to ist someone here, and then the additional expense to update the infomration. However, this does bring to mind an old I dea I had to establish something like a Credit Report where Consmer could report business (of all types) that they deal with (both good and bad), so as to helpo other make informed decision about whom to do business with and who to stay clear of.

It looks like anyone can post a debtor on there, it has a tab for post of debtor, not sure if they charge, couldn't open the tab. I think there is enough information there that junk debt collectors will probably start using it to find out who to collect on also. Like a shopping list. This is awful and should be against the law.

This site seems to be a conduit for people wanting to take revenge on a small business or person that has not paid them. After reading further..they are probably no worse than "Rip-off Report" or other sites that take aim at certain businesses. However they are labeling people and to me that would be defamation of character...possible lawsuit if you know who is posting it.

This may be legal at least as far as the fdcpa is concerned. The FDCPA only applies to debt collectors. If it's the original creditor posting the information and this site isn't actually trying to collect anything it fits in the loop hole.
On the other hand, this is kind of a credit report and I would bet it violates the Fair Credit Reporting Act. Any lawyers out there want to weigh in?

It's definitely a liability, that site would be a junk debt buyers best friend. They could just look up a entry, call a person and pretend that they have the legal right to collect on that debt since they have a couple of pieces of information.
How do I know if a business or person I'm about to sell my products or services to is a Professional Debtor?
You don't! Unless you check their credit report... Realistically, checking their credit report isn't even a guarantee. What if none of the businesses a bad debtor has taken advantage of in the past pursued the matter because it was going to cost them more time and money for debt recovery, than it was worth to recover their losses? In that case, it will never show up on the professional debtor's credit report. The professional debtor won't tell you the names of the businesses or people they've taken advantage of, so you can't talk to them. Checking with The Better Business Bureau won't do you any good either, they only take reports on bad business practices of businesses that provide a product or service, not the business or individual procuring the product or service.
So what can I do?Be proactive! Post ALL of the bad debtors, or professional debtors that have taken advantage of you on this web site. You do get a discount for multiple posts! In time, there will be a comprehensive list of professional debtors in your area listed on this web site. People and businesses that you and everyone else will know to avoid.
What can I do about a Professional Debtor that owes me money?
After debt collections? After collections attorneys? After litigation? After judgement? After garnishment? And still no results? Nothing! Count your losses and move on, write off the loss on your income taxes and hope the next customer or client is more honorable than the professional debtor that just ripped you off! That is, UNTIL NOW!
Now, there is something you can do about a Professional Debtor!
You can post bad debtors and professional debtors information on this web site! At the very least, someone else will see their information posted here and avoid having to use collection agencies, an attorney, etc., to collect bad debts. If enough people see a bad debtors information posted here and these professional debtors begin to find it difficult to find suppliers or service providers to conduct their own business or live their life, maybe they will start paying their bills. If enough people quit dealing with a bad debtor, because they were forewarned, perhaps these professional debtors will see the error of their ways and start paying their bills. Maybe they will even pay YOU!
How do I post the Professional Debtor's information?
That's simple! Click on the "Submit Debtor" link at either the top or the bottom of this page, pay the small fee to post a bad debtors information, and then follow the instructions to post their information for all of the world to see. We know! You, or at least someone out there is thinking, "Great! Now I have to spend more money because of this bad debtor". Let's face it! Paying us the small amount of money that we require to post a bad debtors information, is a whole lot less than it would cost you to file a court case. Have them counter sue and drag it out in litigation for years to come to maybe EVENTUALLY recoup some of your expenses. At least by posting your professional debtor's information, someone else may be able to avoid going through what you went through, and while we can make no guarantees, maybe your professional debtor will even pay you!
What if the Professional Debtor pays me after I post their information?
That's simple! Click on the "Submit Debt Resolution" link at either the top or the bottom of this page, pay the small fee to amend your bad debotrs information. We recommend that you charge your professional debotr this fee as well as the fee that you originally paid to post their information, in addition to what your bad debotr owes you. If you have a contract with your bad debtor that allows you to charge collection fees, this should be easy. Even if you can't charge them this fee, still we recommend that you amend their information, it is a business expense that you can claim on your income taxes. Besides, posting that a professional debtor has resolved the situation with you is the right thing to do!
Will the Professional Debtor's information ever be removed from this web site?
No! Professional debtor's information can only be amended to show that they paid you. This helps ensure that this company or individual won't return to their professional debtor ways!
How much does it cost to post my Professional Debtor's information?
$45.00, about what it costs to file a claim in small claims court, and a lot less than what it costs if you have a collection attorney involved.
How much does it cost to amend information on a Professional Debtor?
$45.00, much less than collection attorneys fees and litigation costs.
Who can amend information on a Professional Debtor?
Only the person or business that originally submitted information on any professional debtor may ament this information.

Hey..I got this e-mail today from the public relations dept.at Craig Hospital:
Awhile back (2 years ago)a Craig grad was selling
advertising on a website. He stated a % of the profits would go to us. It was a bust and we never saw any contributions.
But somehow it got from that to this professional debtors site. We want no part of this and our President just called and asked for a "cease and desist" within a week.
Thanks for bringing it to my attention.

This ENTIRE thing is disturbing!! I thought information on WHO you owe and WHAT you owe, suppose to be a 'private affair'. Someone had said something about 'Googling' phone numbers. My number is suppose to be 'private' and unlisted..it is. But...I found MY number, as well. If someone's name is shown 'to the public', can't they do anything about it? ( BTW...Finsfan, Miami did ALOT better in the game, this past weekend....i thought anyway. I know ALL the teams want to win, but, but IMPROVING, in a game, is a 'good thing' ,too!!).

Hmmm... I've been watching this thread to see where it went, now I think I'll weigh in.
I took a look at the site before the under construction sign went up, and nowhere did it say who these people owed the debt to... so the fear that a collection agency could collect from anyone posted is unfounded.
They are not a collection agency, and are apparently not trying to collect these debts and this is not a credit report. And, the information that I saw, as someone already said is a matter of public record.
I have a question for everyone. People can report businesses to the better business bureau if they don't treat their customers right, and that's ok. But if a business tries to warn other businesses about doing business with someone that doesn't hold up their end of the bargain, that's an outrage. Why the double standard?
Maybe if everyone just does what they say they are going to do... provide the product or service and pay for that product or service, no one would have to worry about it.
