I had a HUGE argument with a CA :) I love keeping them on the phone..lets see, this one was a little over an hour....recording her verbally abuse me. :lol:

Get this...when I told her I would be sending a letter to demand validation, she spouted stuff about not having to do it in 30 days, it could take a couple months..that is when I told her all about the debt collection laws of my wonderful state of Texas. She didn't believe me!! She called me a liar!! Demanded that I send her a -noterized- copy of the statutes....I replied, "Do you want the -whole- Finance Code, or just the half a dozen pages of the debt collection laws?" Then I informed her I wouldn't be faxing anything and she got ever more rude and snide and abusive. I just kept happily recording.

Then I called back and got a new supervisor and played back a portion of the recording to him...he was speechless.....he told me that woman will be terminated. :):):)


[color=DarkBlue][/color][font=Tahoma][/font]Isit not almost comical to see and hear the reactions from some of these agencies when they find out you know the laws and can use them in your favor.
Ohh how I love some of the reactions they have...makes for a pretty good day for me ;)

Yeah I thought that too, which is why I am gonna truly nail them to the wall and send them a DV like the other CA I am attacking, giving them the straight 60 days to either comply or get hauled into court. I am even considering faxing a few parts of the texas law just so the rude Biatch :) can see I was telling the truth and she is in a world of hurt.

I am also going to call back...again and again and see if I can get her again and get her name, so I can include her in the lawsuit.

At the rate I'm going and with how much these CAs are breaking Texas law..Im gonna be in the courthouse more then at home:)

I am going to start speaking to a few lawyers about LVNV since I counted and it looks like I can take them to court for 13,500 (for the number of violations plus trebling as per the statutes.) PLUS court fees:) I might find one to help me.

This is for FYI and others. I have never understood why a collector would harass and threaten a person and yet in the same conversation expect to be paid by someone said collector has completely pi** off! :shock: I know FYI is a professional and I have dealt with good and bad agents myself. You would think that some one would get more money by being considerate on the phone. Now playing from their side I can truly understand the frustration when dealing with irate people,but kindness goes a very long ways when unknown persons are conducting business affairs.

I can understand the meaner tatics. I've had to employ them myself but not too often. I don't do mean well. But the times I have had to use it was because the person on the other like was being a complete ahole unprovoked by me. The screaming and the cursing, the i don't cares, the sue me.. ect those do wear thin. I feel bad for the collectiors who collect on the older stuff. I am fortunate to work on the paper that I do.

The important thing to remeber about collections is that it isn't customer service anymore. That time has passed. I think collections should be professional in their attitude and manner but they don't have to be nice. When I get a new collector I always tell them that they have to find their own way about getting accounts taken care of. As long as they follow the laws and get their jobs done I am happy.
