I have wrote about this before but didn't want to pull up an old thread so will try to make a long story short. I have a few accounts with dell financial. They keep getting passed around from agency to agency. I'm not new to the forum so I have taken the correct steps. I stopped the phone calls--told them written correspondence only. Go straight forward with the collection agency and ask for validation. I don't hear anything for a few months, then I'm hearing from a different collection agency. we have been going through this song and dance for a while now. everytime I ask for validation, they pass it on. okay, on one of the accounts, they didn't pass it on this time. After I sent validation letter, they sent me back a proposal to settle for half of what was owed. nothing in response to my request for validation. I didn't think they were suppose to contact me again unless it was to provide proper validation? no validation, just an offer to settle. what now? send them another letter? thanks shirley

Did you send your cease & desist letter by certified mail. You told them not to call you and only contact you by mail. Was the validation request also in this letter.

Unless you worded your letter a different way...they may still be able to contact you.

Something like....

I am requesting validation of this letter. I am also requesting you to cease & desist contact.

and so on and so on...

Is this still the same company???

They're not calling me. so they are honoring the do not call request. I sent them the validation letter and added the do not call request at the bottom. instead of me getting validation, they're sending me a settlement offer. I think I covered my bases pretty good. I have learned ALOT from this forum and Roxette has helped me alot by telling me what to say. This time, its the same company. usually when I ask for validation, it gets passed on to someone else. The same company wrote this time. didn't mention a thing about the validation, just that their 'client' allowed them to offer settlement of half. I feel that maybe theres not validation since they changed the subject from me asking for it, to offering me a settlement. should I send another second letter--copy of the first--asking again for validation? thanks, shirley
p.s. I responded to your post yesterday but it never went through. fluke thing, I guess.

I would return the settlement letter (make a copy and keep the oringinal) with a copy of your validation request. You might even want to type up a new cease and desist letter stating that if I do not recieve validation within 60 days I will consider this a mistake on your part and that the matter is closed.

    Creditor:

I recently obtained a copy of my credit report and noticed that your company has reported me as having the above listed account as: (delinquent, sent to collections, etc.). I wish to bring this account to a resolution that will be fair and beneficial for both of us. Therefore, I propose to pay you X monthly payments of $, or forward a check to you in the amount of $ as payment in full, provided that you are willing to send me a letter stating you will report this to any and all credit reporting agencies as: 'PAID AS AGREED' or notify me in writing that you agree to delete this item from any and all credit reporting agencies.

I WILL NOT agree to accept a 'PAID P & L' or 'CHARGE OFF' for an additional amount of time on my credit report. It is my position that I have suffered enough as a result of this problem.

Upon receipt of your letter I will send you a cashier's check or money order in the amount of $.

    Sincerely,
