Well we are dealing with a collection agency with horrible collecting practices. We purchased a lap top and desk top computer from Dell Financial in Feb 2005 for 2000 with 0% finance charges which changed as soon as the purchase was complete as we did not qualify, I believe our finance charges are 29.9% now. So I paid them for 2 years towards taking care of this debt. Well in the spring of this year we ran into some financial problems, as my husband is the only one that works because we have 5 children at home. We fell behind in our payments, when I tried to figure out how we could catch up the minimum payment was above 500 with all the late fees and finance charges. So our account was sent to a collection agency Valentine and Kebartas, they had started calling about 2 months ago but I assumed they were calling in regards to another debt that we were fighting. So anyways long story short I ignored their calls and letters, when I did answer the phone they never said they represented Dell. Well on October 16 they called my home and my 14yr old daughter answered the phone, they asked for my husband or his lawyer and she said he was not home as he drives a tractor trailer away from home 5 days a week. So they said they were coming tommorrow she responded by saying he would not be home tommorrow, they told her (in not so many words) that he better be home the next day or they would have to notify the authorities. She called me on my cell hysterical that her parent was going to be arrested, and what did he do. So when I got home I called them and found out who they were and what they wanted, I was very upset that they would threaten my child. The woman who answered told me that they did not threaten people and my daughter must be mistaken, I asked her if she was calling my daughter a liar, she said I knew my daughter better then she did. Anyways she proceeded to tell me that I needed to pay this debt or they were taking me to small claims court. I was still upset by the earlier phone call and she was going on and on about my daughter not telling the truth so I told her to listen to the tape, supposedly they tape each phone call. She hung up on me. The next day I sent an email to Dell and tried to call them but they just direct me to the collection agency. So I posted a complaint with the FTC. I got a call that day from them from someone saying she was a supervisor and she was calling to resolve the problem. She said the woman shouldnt have threatened my daughter, she would look into it, but what could I pay on this debt. I told her our financial situation and told her I could send them about 100$ on the 10th of Nov. she started telling me they needed it paid off in 6 months, I told her that we couldnt afford it, she agreed and said for me to pay what I could. Okay everything was being resolved and then today the supervisors supervisor called me about the debt and that I had to pay it within 6 months I told her I couldnt, she said I would or they would bring me to court I said go right ahead. She said I was rude and would I be this rude in front of a judge, I told her I would tell the judge exactly what I was saying to her especially the part about them discussing our account with my minor child and threatening her with her parents arrest, she hung up on me. Are they allowed to threaten a minor? Or threaten my husband with arrest? I know we need to take care of this debt and I will eventually it just has turned out to be far more then we anticipated.


Welcome to the Community :D The answer is no- they cannot threaten you or your daughter. They can only verify if the person lives there, not discuss details of anything.

I have had CA tell me they wanted $300 a week, and I have sent them a payment I could afford, they have never returned it. Be sure and send them a money order,keep copies of all correspondence,including phone calls, and send any correspondence to them certified, return receipt..Good luck,feel free to ask questions..karen
