what do I do now???? Im trying to pay!

I had a settlement agreement with CIR LAW offices to settle a debt. I was waiting for the letter with the settlement agreement so I could send them the payment.

The woman who i guess was handling my account called me today after I left her a message stating I had not receivedthe settlment agreement letter in the mail yet (two weeks have passed by).Well then she procceded to tell me that the offer expires today and if I didn't do a Pay by phone check payment the settlement offer was off the table. I told her I didn't have a checking account only savings but I was more then happy to do a Western Union payment or mail her a money order. She told me no and she was going to file a Lawsuit against me, and she then hung up.

I never got the settlement letter! I don't wanna get Sued. Im willing to pay but not the original amount.. Should i try to call a manager in her department tommorow and explain that I never received the letter that she said she was gonna send me? Will that do any good.

The collection Agency is named CIR Law Offices, they have a website named cirlaw.com


It is a bluff. You did the right thing. The very first thing you need to do is send them a debt validation letter and make them prove the debt is yours and that they can legally collect this debt. After that you start the settlement process. Do not ever give them access to your checking or savings account. Do not pay them a penny without having the agreement in writing first. I would call her back and give her a fax number and tell her to fax the agreement to kinkos or some businees that takes public faxes. I would demand that they extend the settlement period by at least 5 business days since they have not mailed the agreement. I would verbally agree to do a pay by phone (of course you really are not going to though) if they send an acceptable signed fax agreement and they extend the period. After you receive the fax then send a certified bank check return receipt requested to their company with the settled amount. I would recommend getting a financial diary or a calendar and keeping notes about your conversations with them. Write down that you offered to send them the agreed amount via western union after you received the settlement letter but they refused to send the settlement letter and accept the payment. I would also recommend that you get a tape recorder and record all conversations you have with this idiot. If it is illegal in your state to record without their permission then make sure you start recording and state that you will be recording the conversation and if they do not agree they can hang up. Most states it is legal to record without doing this but verify that for your state.

The bottom line is she is trying to make you think she sent an agreement and that it is going to expire. She never sent it. She is trying to use the fictitious date to pressure you into paying and since there is no agreement she will come back for more at a later date.

Dollars is right- get it in writing, and keep notes!

I don't know how many times in the past that I had a "settlement" set up, without writing, and the next thing I know, it was cancelled for various reasons.

They will try and pressure you into anything. If they say something about your savings account- pretend you didn't say that. If they think you have extra money- they will really hound you!! Good luck..karen :D
