OC Refuses to Take Marking Off of Credit Report
Date: Thu, 11/01/2007 - 08:36
I asked the banker at my location about how I would go about getting a letter stating the account had been paid in full, how to have the CA stop attempting to collect, the whole nine yards. He gave me a 1-800 # to contact them, so I just spoke with someone on the phone. The woman I spoke to said that they will be sending a letter to me, stating that the account was paid in full.. but I'm basically shhh outta luck to get it taken off of my report, since it was a valid debt.
I'm not sure how all of this stuff works, so is this true? Is there anyway I can dispute this once I get the letter from them? She said they'll be notifying the CA that the account is now paid, and on my report it'll say Paid In Full, but it'll still be a negative mark on there.
Any help??

It is valid information so it is legal for it to remain. There are two ways to remove it.Either dispute thru bureaus or goodwill removal by bank. You should also check out your chexsystems report as they may have placed you in there to making it difficult to open checking accounts.

Yeah I'm already in ChexSystems; I opened an account at another bank awhile ago that gives you second chance checking so I'm content with that. I don't think there's a way to get out of it for the next 5 years though.. I may be mistaking.
Since the OC is refusing to remove it, how can I dispute it with the bureaus? Am I even able to, since it was paid but at one time bad? Is it worth my time?

Just in general, am I able to have this taken off? Or is this stuck on there for the next 7 years? I'm just wondering if it's even worth the time to write up a dispute letter, since well the report will accurately report it as Pain In Full.. although it'll still be a negative entry.
If you don't dispute it then yes it will stay seven years.

I realize that, what I mean is if I DO dispute it with all 3 bureaus, given that the account has been paid.. is there a guarantee it will come off? What has to be done on my end to get it removed? Is it even possible?

This is from my free report from TransUnion I got in August. My Equifax one says the same thing, just worded a little differently.

Ok this is a collection account placed by a lawyer. I am
attaching some code from the consumer data industry association referring to collectors removing a trade line.

collection agencies must delete accounts that have been canceled and returned to the creditor.

Debt Purchasers/Factoring Companies must delete accounts that have been forwarded or sold to another entity.
Start by writing a letter to lawyer stating he is reporting a collection account improperly according to CDIA Metro 2 format.
As far as CRA disputes your trade line is hosed with errors.

Hey I really appreciate all of your help so far, Cajun. However, what you just typed totally went right over my head.. (not that you didn't explain whatever right - I'm just not up to date on all this stuff!).
What does it come down to here? What would be my first step of action??

The code I referenced is from the Consumer Data Industry Association Metro 2 format. This is the software everyone uses to update credit reports. A letter to the lawyer with the codes I highlighted may help you get it removed after you make them aware of the Metro 2 formating error. If that does not help then we turn to the credit bureau dispute. There are two obvious errors on there right now.A collection account is not considered open as you were not granted any credit and the balance is incorrect with status field also because it is paid in full. I would start the credit bureau dispute with a detailed dispute. Somewhere along the line of I never opened a credit account with a collection attorney and do not recognize why he is on my report.

Are there any detailed dispute letters I could go by?
If I told the lawyer of the formatting error, wouldn't they just go and "fix" my report then? If I notify the three bureaus, would this "laywer" be automatically notified of my dispute??
Thanks again for all your help, I just don't know where to begin.

I looked at the sample letters, and none of them really pertain to my situation. Not only that but I didn't see one involving Metro 2 errors.
Can anyone else lend some advice??
