The statute of Limitation in Colorado for written contract is 3 years and for oral contract, it is 2 years.
The statute of limitation is calculated from the date the account showed last activity. If you make any payment on a defaulted account, the SOL is renewed.

Based on the state laws, every state has its own statues and you are within the legal collection period before the expiry of the term. Under these circumstances, as your debt is past the statutes, you are neither required to pay the debt nor can be forced into any legal actions.
Remember, if you sign any promissory note or make a payment towards this account, the SOL will be restarted from the beginning and you will be brought back under legal actions.
Has the company sent you anything in writing about this account? Place a dispute highlighting the item in writing. Send it through certified mail with return receipt requested. Keep everything documented in a file. If the matter ever reaches the court, you should be present with all the necessary proofs of the facts.

I have a company trying to collect money from an old Sears account I opened in 1988. They state that I haven't made a payment since 1994 and that I owe $60.00. I contacted Sears and they tell me that I owe nothing and that account has been closed. I told the dept collector that I need some sort of documentation to prove that I still have an unpaid balance. It's been over a year now and they still haven't sent me anything. Now they leave an automated message on my answering machine at least 4 times a day to call them back. What should I do now?
