unifund on my credit report

Hello, my name is joe and my father has the same name. My parents never put jr so we have the exact same name. Now my father had this cap 1 card with a limit of 5k now a few months ago he got a letter from unifund saying he owed 11k the debt is about 2 years old and was created in ny we now live in florida. Now I did owe cap 1 myself with a balance of 900 bucks I settled that with northland group a few weeks ago and now my equifax report tonight has unifund saying I owe them 12k this is my fathers debt not mine. I never had a credit card worth 5k. What is my legal course of action to protect my name? what can I do to help save my fathers name? He does owe this debt.


Both you and your father need to send a debt validation letter (you can find a good template via the first link in my signature) send it USPS certified mail, return receipt requested. Since they have filed on both yours and your fathers credit report then I'm sure they know that you are not the right person and have probably violated the FCRA by knowingly filing false information. They are probably also trying to access interest that is far beyond the legal limit.

this is not the first time I had an issue where something was supposed to be in my name went on his report. The first time something like this happened was I subscribed for directv and they put an inquiry on his report. we have the same address since I am 23 and still use home as my mailing address. besides the validation request is there any legal action I can take against them?

If they have knowingly filed false information then you can file a civil suit for violation of the FCRA for up to 2,500 per violation or 1% of the companies net worth, whichever is less. You can also send a debt validation letter to the collection agency (you can find a good template for one in my signature links) You can also file disputes with the credit bureaus.

This is not uncommon in credit reporting for Jr's and Sr's to merge onto one report. Heck my husband is a Jr and it happens to him and his dad frequently. Usually the second SSI # shows up on the CR somewhere. It is important that you always use your designation...Jr, Sr, III....whatever. This is not done intentionally and you simply have to contact the CRA reporting the error.
