stopping harrassing calls
Date: Fri, 11/09/2007 - 08:31
For 4 months now they call us 4-10 times a day. We have tried to have our number removed but they don't seem to understand.
We think we have the one in Kansas stopping tho now it is a number from New Jersey.
Is there any way to stop them.
Thanks

Explain to them that it is not yours, your entitled to dispute the debt. (you can find a good template for a debt validation letter in my signature) send it certified mail, return receipt requested. Until they can validate the debt (and if it's not yours then they never will be able to) they must cease all collection activity.

I have tried that Ang, I can't do a cease and desist as it is not my account. Tried one and they said I could not do it.
JCEMT, I will try your suggestion. I am so annoyed
They have said they are taking our number off, and it gets back on.
Over and over it goes.
I have even reported Dell Financial services to the BBB. To no avail.
would not be bad if it was my account but it is not mine.
Thanks

OH WOW upset!
Now this is one strange case huh? U can't do a cease and desist letter yet they can continue to call u???
That's ridiculous! Maybe send both the cease and the dv and also explain to them this is not u (which i'm sure u have before) and if they do NOT stop calling u, u will indeed file suit on them! Have u tried looking for a naca atty in ur area? Maybe, just maybe, an atty will get them to stop this silliness!
please keep us updated as i'm very interested in hearing what happens,
Good Luck,
Ang

You can send them a cease comm. letter regardless, of who the account belongs to. Your saying do not contact me, period. You have that right, and each time they violate it after you have sent written request that is $1.000 per violation.

Well that IS true JC cuz if u used someone as a reference and they contact them they can also send a cease and desist letter! Didn't think of that earlier...

Wait a minute. Just so I'm understanding this.
Encore advised you, that you cannot C&D them from calling you about an account that isn't yours, because the account isn't yours? Am I confused? Did you get this in writing? Or was it a phone conversation?
Man I wish this was me they were doing it to, I could have so much fun with that.
I would record any and all calls (check your state laws concerning recording calls) you have with Encore where you advised them the account is not yours and tell them to C&D, and see if you can catch them saying this. If you have it in writing already, even better. Then seek out an attorney that handles 1 cases.
I would also take everyone else's advice and send a DV and C&D letter, CMRRR. Ask the Encore representative for the address during one or their collection calls. I'm willing to bet, once they receive that letter they'll stop calling. If not, *BAM* another violation of the FDCPA.

Yes UnemployedRon it is right.
They said because it is not my account a C&D letter will not work. Oh I have the address but did not register the first one I sent.
Yesterday my husband lost it and yelled at the person. Didn't help tho got another call a few hours later. They of course hang up.
I called back and got someone who said they were supervisor. Once again for soooo many times I was told our number will be taken off.
Then I tried calling Dell Financial Services who is the root of the problem, Of course I got India, She also said out number would be taken off. It was suppose to have been taken off in August when I filed the BBB Complaint.
I have now filled a FTC complaint. So has my daughter in law as it is their account. She has heard back from them, and they told her at this stage all there is left is a lawyer who will take case on the contingent of winning. I have not heard back from them but as long as she did.
Unfortunately at 8 am this morning, What happens, we get a call from IC Systems on the excat same thing. My husband had answered the phone, the girl was polite but talked so fast, anyhow, he gave me the phone she starts rattling off that my husband already verified that this was our address and she was calling in regards to the $2400 we own. I said wait that is not our account it is our son's. She wanted a number, I gladly gave it. I said please take off our number, she said now that they have another number they will. I wrote down time and name of person this time so I am ready.
Thanks everyone for all the suggestions.

Geeze upset these people are really harassing u!! I would immediately send them a debt validation letter with cease and desist and explain to them in the letter that this is NOT ur acct!!!! Once they recieve it i think legally they are able to call u "one" more time and that's it! Keep everything documented and if the calls continue look for an atty at naca.net
Much luck to u and keep us updated,
:D

"It doesn't apply to them because it's not your debt"... then why are they calling you? Send a cease communications letter (return reciept). If they call after that, ask the person if they'd like to a party to a law suit. Sue them.
