Do I have any legal rights to place a stop on wage garnishment in Ohio? I have a hearing to attend tomorrow, to face my creditor, and explain to them why I can't afford the amount the law allows to be automatically deducted from my pay check. They already have a judgement for the garnishment, as I never received a letter for a court date, I am recently seperated, and living on the bare essentials. Any advice would be helpful. Thank you.


I don't know what the laws are in Ohio but I searched for an answer to your problem, and I found a site that said to stop your wages from being garnished you could file bankruptsy. I would'nt recommend this though. However it is your decision and if it's something you might be interested in follow this link:

In my opinion talking to your creditor regarding your problems you will be facing if they garnish your wages is a good idea. Either of you might come up with a deal that is feasible or even your creditor might agree of a payment of less than the full amount. If you make a deal, be sure that it is in writing and signed by both the parties. If its not working then within 15 days of receiving the ???????Notice of Court Proceedings to Collect Debt,??????? you can

??????? Pay off the outstanding balance to your creditor. You must have received a form called ???????Payment to Avoid Garnishment.??????? with the first letter sent by the creditor to demand payment. As said by you in the post that you are ???????living on the bare essentials??????? then in such case this option is not viable for you.
??????? Apply to your county court or local municipal for the appointment of a trustee.
