So I got caught up in the PDL since my ex husband left last year and did not help pay for any of the debt and I had no choice to get them at the time. I have some I am still paying on and want to know if there is anything I can do because I just cant make it anymore. These two I have been paying on for a year

Aferry, Have you done anything about your bank account. If not, you need to close your bank account and open a new one to keep the pdls from debiting anymore. Also be sure your account can not be forced open by the pdl's debiting your account. If you can not close your account you need to have the bank place a debit block on your account so no money can be debited out. But before you close your account you need to read the following on closing your account. This was posted by Goudah a Moderator and is very informative.

aferry, holy crap! :shock: I had to light a cigarette on this one! It makes us all sick once we "do the numbers". Amazing, isn't it? They will take you for all they possibly can. I wish to God you had found us sooner. As you will see from the state pdl law that roxy posted, criminal action is prohibited. You would not get into trouble for closing your bank account that these plds have access to. Since you have not done so yet, your first step is to get this account closed A.S.A.P. I also see that roxy has posted information regarding closing your account. Read that (if you haven't already) and post ANY questions that you have. You need to either close this account with the assurance it will not be "forced open" due to pending pdl debits. If they can not assure you that it will not be "forced open", then you need to have a hard debit block/hard hold put on this account. If you have direct deposit, stop it now. Open another account at a different bank and have your direct deposit go to the new account. As you have now noticed, these pdls will not stop debiting your account. They will debit it for thousands over a $300 loan. Some of these pdls are not even licensed/legal to lend. Now, one of them - CashNetUSA - will be licensed/legal. However, you can contact them to make alternative payment arrangements other than debiting your bank account. If you can get your bank account closed/blocked NOW, we can help you with dealing with these pdls, okay? Can you please go to the bank and get the account straight to where NOTHING will hit it. Whether it be closed with the promise of not re-opening or blocked with the promise of nothing going through. You need to do this first. This is the main priority right now. To get your money back under your control. We can do this together. Please go to the bank and get it done. Then we can move forward. We need to get these taken care of. We can help you here.

I had an account with BoA and no it was not forced back open, I actually spoke to someone in the fraud department and asked them to "freeze" my account due to unauthorized debits being taken from my account, they figured it was my debit card (ha ha) and completely froze my account. I have had ach debits hit and bounce back to the originating company. I do not use this account any longer and have moved to a totally different bank

I feel your pain, been there!!! I sent everyone of the payday lenders a letter stating they are not to debit my account and also, to only contact me by mail or email. If they are illegal, let them know that you know they are illegal and don't give into them. If you look at the laws of you state, it will be a big help. I contacted Cashnet and they were easy to deal with. I had a payday loan with paydayservices and figured on a $300 loan I paid $1110. At that point I became mad and decided I would not do it anymore. So don't fret, get to work and get out of the situation. People here are really helpful.

Let me just jump in real quick. aferry, I understand roxy sent you a letter to send to your pdls. Please get your bank account to where the pdls can NOT debit it at all BEFORE sending any letters/emails to them. If they catch wind that you are even thinking of closing/blocking your account, they will be all over it. Get the bank account straightened out first, make sure your money is safe, then you can work on the letters. The bank account is your priority.

Great! :D I hope they can do "something" before the pdls hit again. But I was just freaking out because you do NOT want to let the pdls know what you are doing. Wait until your money is safe and then send the letters. Because they will continue to try to hit your account even though you told them it was closed. They are relentless.

I have BoA as well and they are cooperating with me. They saw that my account had never been in the negative until this past Monday. They are actually going after the pdl company I went through and trying to get my overpayment and the overdraft fees as well. I'm sorry to that you didn't find this place sooner. I just found this place on Monday and I will tell you what. It was the best thing that could of happened to me. These people here will help you in every way they can. You just have to make sure you follow through. Take good notes and pay attention to details. You will make it through this! I just had one pdl and it was killing me. I won! They are no longer debting my account. I have a letter marked PIF and believe it or not, I'm still in good standings with that loan company, which I'll never borrow from again. You will be ok. Stick around!

BOA seem to be going through an attitude adjustment when it comes to these things. I have read good things about dealing with them on a local level. Their customer service national base is a nightmare. Here is a quote from a BOA CSR. "I decide who gets to speak with fraud and I have determined that you don't have a fraud case."

aferry, I filed with the state the pdls are in and I used the names and addresses of where I sent my letters to. It is done on line so you can type up a brief narrative in your word processing program and cut and paste it to the for for each case. That is how I did it..had to adjst a little for each one but saved me from having to retype my complaint nine times. :D

When I called BoA, the customer service person I spoke with was very sympethic and helped me out for a little while. Then when he connected me to the Fraud department, they were very helpful as well. I called the national customer service line to. I guess it just depends on who gets your call. I'm sorry Frog if you didn't get any help from them.
