Then attached is another three pages titled Release...It has the following sections: Release by the borrower, no suits, no claims assigned, Complete defense, non admission, entire agreement, sucessor and assigns, ammendment:waiver, applicable law, representations, invalid provisions,counterparts; facsimilies. I am supposed to sign this and return it.
Does this mean they are "writing me off" so to speak. I do not mean to come across as stupid but I am not sure whether or not to sign this. It looks ok but I am no expert and with my luck I would sign it and I would find out I am signing away my life and my 1st born.

roxy, this is the same "type" of letter that I have received from pdls. If it is indeed the same (and the way I'm reading your post, it is) then once you sign the mutual release agreement, they will consider it zero and closed. All they want you to do is sign the dumb paper stating you won't turn around and sue them or anything. Hell, when I got them, I signed them. And I received a notice that it was indeed closed and no more communication would be received from them. And it was. It was done. Over. Nothing hit my credit report from them, etc. They were DONE. So, I'm thinking this would mean a HAPPY DANCE once you sign that and they send you the confirmation stating that it is indeed closed. Can I start the happy dance now???? :D

It sounds like a general release with them recognizing that they had done some haneous (spelling, I know) stuff to you, but willing to settle it on the spot by paying themselves the cash to wipe out the debt. Basically, their attorneys are saying not to charge it off or write it off, but pay it out of their own pocket or face suit.
