almost 18 year old debt

hi i have a question maybe someone can help.i had a credit card from sears when i was 18 im now 42.i ran into some money problems back then.think last time i paid anything to them was back in 1995.now im getting some notice from a ncc collection agency says regarding nco/assignee of sears trying to collect this debt.first statue should be up i live in florida and it was written off in 1995.can they collect this debt and they say they are going to put on my credit report.i live in florida statue i believe is three years.they call all hours.i tried calling them and telling me this debt has been off my credit report for years now they say they are putting it back on.can they legally do this.i thought bad debts were only on 7 this is well over that.thank you in advance for any help


Ok Danis, no they can NOT legally re-age this debt... i have just posted on this in 2 other threads. (must be the day for CA's reaging accts) I would send them a debt validation letter and also a cease and desist letter....

Also, if u didn't pay this debt they can collect and they can sue but, and a big but here, ud have to use SOL as ur defense!!

Just change the wording to meet ur needs and here's the cease letter:

I would jsut put these 2 together in one envelope and send it return reciept requested.
Also at the bottom of the cease letter he has a mini miranda about making a debt collector follow the law... it's just a snarky comment to them so u can leave it out if u choose to do so!
