I had a message on my phone, I was away from my desk and it was the Manager from USA Payday. He of course sounded very harsh and mean, told me to call him back asap. I have sent them letters. Originally I had agreed to pay back principle that was borrowed, but the woman I spoke with still took charged me the $90 fee and the payback principle payment of $100, so when i closed my account these all got sent back. I decided at that point they were not playing fair and I did not want them to have access to my account any more. So now I am sure they are really mad. Any suggestions? I have sent them one letter any ideas on a second one I should send?

I sent the following email to USAPayday loan:

Quote:

PAYDAYUSA,

It has come to my attention that your company is not licensed in the State of Illinois, which is required for all payday lenders loaning to Illinois
residents regardless of the location of the business. As such, I was not legally permitted to enter into the loan contract with you, and based on
advice of counsel and an opinion from the Illinois Attorney General's office, our contract is not valid. Therefore, I am immediately and
permanently revoking my authorization for you to debit my accounts.

Additionally, I am requesting that you immediately place me in a do not loan our contract is illegal in the State of Illinois.

I prohibit you or your affiliates to contact me via telephone at my place of employment or my home telephone number. I also prohibit you from calling my references listed on my loan. Once I inform you of this, you must stop the telephone contact immediately or you will be once again breaking the laws of the state of Illinois

You are also hereby notified that I am revoking any voluntary wage assignment I may or may not have signed. I no longer authorize you, your company, or your affiliates to attach any part of my wages or contact my employer for your collection purposes.

I am revoking your right to debit my checking account any longer. You, your company, or your affiliates are not authorized to debit my checking account at all. Please be aware that I have informed my financial institution of this situation and they will also be receiving a copy of this correspondence. Any further attempts at debiting my account will be rejected by my financial institution.
I expect your affirmative response within 24 hours of receipt of this email or I will request the assistance of the State of Illinois in seeking injunctive relief from the contract.

Respectfully submitted,

and received the following email back from them:

We already spoke on the 8th and you agreed to 3 payments of $100 to clear up the account. If you are not revoking all authorization on your accounts on file then how do you want to pay back the $300 that we gave you? Just let me know when you have a chance.

Thanks,

Any suggestions on how to respond, I just want to be very careful with having everything in writing. Plus I know these guys are illegal.
