Help Me Please!!!!!!!!!

In July of this year got a payday loan for $250. Now I remember looking around at them on the internet but I don't remember actually following through with any of them. Anyway, $250 was deposited into my account. Here it is mid November and I've paid $675. They automatically take $75 out every 2 weeks. I knew that I had to pay more back than what I borrowed but this is insane. I need some serious help here.


I am in Illinois.
On my bank statements it shows SSM Group LLC but when I call the phone number on the statement, and get a recording, it say's OSL Marketing.
I asked my bank if they could give me any information and they couldn't help me out.

I got a loan from OSL..I just stopped paying them..actually youre better, you paid them for how may weeks..I just paid them once and said goodbye..put a hard block o your account to avoid NSF fees..talk to your branch manager so you can open a new account..these people wont stop debiting...file a complain to the better business bureau..check the number of your state attorney..they'll eventually stop..unlike you, I actually return their call..if they scream, I say nasty things to them..its take it or leave it...yesterday, some guy from payday loan called me and asked me why my account s frozen..I said because they froze it..LOL..u have one loan..you'll get out of it

Stacey, I found all of this info in a couple of posts on this fourm and compiled it for you..

Illinois has definite long-arm statutes, meaning that a company from another state, who is doing business within the state, must follow Illinois law. The PDLs cannot use the argument that "the loan is under Nevada law (ow wherever they're from)".

The Illinois Payday Loan Reform Act (which sets forth the terms in the above post) was enacted in December 2005. Any payday loan you entered into after 12/1/05 must follow those laws.

Simply put, if the loan is not "legal" then they have no recourse against you if you do not pay it.

I'm so lost. I've never dealt with pdl's before and I didn't realize just how big of a mess this is. I am going to call them Monday morning and find out what I can do because I feel that $675 for $250 is more than enough. I would really hate to close my account and all. That's going to be a big hassel considering I have my direct deposit and everything going in there.

stacey, I hate to tell you this, but you're probably going to end up closing your bank account. I know it's a pain; however, as you have found, these pdls will NOT stop debiting. You have overpaid by $425.00. You should be refunded. However, as long as the pdl has access to your bank account, they are going to debit until they feel as though you're "done". And, you have been "done" for quite awhile now. Just contacting the pdl and/or sending them a letter telling them to stop will not be enough. If you have any questions regarding this, please post. :wink:

I will call on Monday to the pdl place. If I have to close my account, I will but I hate to do that. I can't believe that these places get away with doing these types of things. Like I said before, I understand paying back more than what you borrowed but come one. I've paid back 100 plus in interest. Should I contact the BBB? I would like to help with the fight agaisnt these types of places.

stacy, of course you can file a complaint with the BBB! Actually, it's encouraged! You can file with the BBB and also file a complaint with your state AG. If you need help doing this, just let us know.

Ok.......so I called and they said that the $75 every 2 weeks in sonly a finance charge and I was to call in to have the enitre amount taken out. They said that I have to pay another $325 to have them stop the debt. She did send me my agreement. Here is what is states.

Ok, I called my bank and they have put a stop payment on that particular debt. They also told me that it would be in the best interest to close the account and reopen a new one. They are also going to go after this company about all the extra money paid into them and my overdraft fees. I also called the loan company and they are stating that they can get ahold of the lender and try to get the account 0 out but she couldn't promise anything. She did state that she would give me a call back and let me know what the lender said. She stated that I agreed to Nevis law and was very snippy with me. I am so angry right now I can't see straight.

I plan on opening a new account for sure. That company made my account go into the negative and now I have to bring this one up first. I'm so screwed. I appreciate all your help on here. I didn't know what to do or where to turn. I did get some good advise from a lot of people. Thank you to you all. I will keep you all updated as to what happens. I'm suppose to get a call back to find out if they are going to zero my account at SSM Group. I sure hope they do. If they do, I wont have to close my account. I will be sooooooo happy.

Stacey, We all remember the feeling when we posted our first post and that is one of the reasons I stick around. I am happy we were able to help you. Please do stick around and let us know how things are going. I really did not want to close my account but in the end had no choice. You will do what you have to. Just be sure that if you close your account it can not be forced back open. It looks like the bank is working to help you but you never know what can happen.

Please listen to everyone here. They are required to abbide by the laws of Illinois regardless of what they tell you. You have way over paid them and you do not have to pay them another cent. File complaints with the regulatory agency in Illinois and the attorney general in both states. Also the BBB and the FTC. Send SSM a certified letter demanding a refund. Do not be afraid of these thugs. They do not have a legal leg to stand on. If the sell you to a collection agency the CA will never be able to properely validat the debt under Illinois law. You have nothing to worry about except dinner on Thursday!

Just an update...........this Christina lady was suppose to call me back today and let me know if the "lender" was going to zero out my account and would you know...........she didn't. I called and left a message for her to call me back. I have a feeling that these people are going to put up a fight. Well, little do they know............I fight back! Thank you again to all of you. I'm not going to give up. I will be calling again tomorrow. I mean if they are collecting money, they call everyday until it's paid. Well, it's my turn. I'll call everyday until this is resolved. I don't know if I said this earlier but I also e-mailed the BBB. Does anyone know if they will contact me? Is there anyone else I should be contacting?

The BBB will most likely contact you throuh your e-mail address you provided, I did have one that sent me a letter. IT ususally takes a couple of weeks. You should get a notice once the case is assigned and then you will not hear from them until they have contacted the company and heard their side. Then they send you a notice with the companys repsonse and give you a chance for rebuttal. Sometimes the company does not respond and they let you know that and will close the case. I like the whole turning the tables idea... I used that with a CA and it was really fun after awhile. :lol:

I'm not worried about them to be honest. When I talked to my bank, and they told me they would step up to the plate and go after them, my worries was over. They looked at my account history and never had my account been overdrawn until Monday! They are going after them for overpayment and overdraft fees. I only had one other time someone took money out of my account (a cellphone company) without my permission. I fought with that company for a month. I got my bank involved and my money was back in 48 hours. SSM Group has been told that not to debt my account due to overpayment. My bank has but a block on that company but like someone said earlier, they can get around the blocks. I am working on making my account to the good and then stopping my direct deposit. It will go in this week but next week, it wont. I'm still waiting on SSM to call me back to. I tried to call back last night and again this morning. No answer. Go figure.

Oh.........anytime these companies want their money, they have no problem calling you 5-6 times a day. When the roles are reversed, they don't want to answere thier phone. How nice is that. I will for sure contact the AG and FTC as well Cann. I will do whatever I can to help put a stop to these people.
