I don't know if the letter will help me. My loan is through SSM Group LLC. and I'm in Illinois. I borrowed 250 and paid back 675 to date. I'm in the process of having them stop the debt of my account. My bank is on my side and is going after them as well. Should I send this company the letter and if so, can someone please send it to me. Thanks in advance.

Tina, send the letter and also send them a letter revoking any wage assignment agreemnt you have made. They are one of the worst when it comes to terroristic collection tecniques. They will threaten to "assign your wages." Wage assignments are not legal in Florida and are strictly voluntary where the are legal. Most employers are not aware of this and when they receive one they think they have a legal obligation to honor it. They do not and in Florida if they do they are resonsible for paying you back. The downside is that the regulatory agencies in Florida have many poorly trained employees, many of who will tell you otherwise or push you off to another agency. Florida does not have a state dept of labor and the US Dept. could not care about state law. You must go to your employer and show him or her your revocation letter and expain in detail the differnce between assignment and garnishment. Garnishment is also not allowed in Florida if you are head of household unless you agree to it!
