Who am I missing... trying to get money back

On 11-16-2007 I noticed that there was 400 dollars taken out of my checking account from Usfast cash. I had taken out a payday loan from them on Oct 3rd in the amount of $250. At the time my loan was due, my bank had put a freeze on mychecking because my account was overdrawn, and the "fee" that they take out was returned to USFastcash. At No time between November 3rd and November 16th, I had authorized Usfast cash to take money out of my via e-mail, phone or otherwise.

On 11-16, 2007. I spoke to the branch manager from my bank to fill out an dispute form, however she wouldn't let me because she said "you agreed to their terms by hitting submitt" In Usfast cash's conctract it states they will only collect bounced check fee of $30 dollars. Kept saying that she useto work at a payday loan place. She wouldn't even look at the application, and this is even after seeing the e-mail on how much I was approved for.

I've filed complaints with:
Complaint made to WI Department of Financial Services(,payday loan & bank)
State's AG office,(payday loan & bank)
BBB (Against the payday loan)
and National Credit Union Administration-Bank
RippoffReport(payday loan)

And i'm now trying to find who the branch manager's supervisor is, but haven't heard back yet (Have an e-mail to the person who I orginally talked to about opening my account)

Who am I missing?


Your branch manager is crazy. I'm glad she worked at a pay day loan place previously. Good for her. Yahoo. I bet it was a storefront which operated legally. In this case with USFastCash, they are an unlicensed/illegal company. They are lending illegally. And if you revoked their debit authorization, they are debiting your account illegally. For your branch manager to do this is totally insane. Next higher person up, please. Call the friggin corporate office. This is an unlicensed/illegal company taking unauthorized transactions from your account. Is this branch manager nuts???

cannr, I didn't actually revoke them till Friday when I put a stop pay on them. I thought they would actually try putting the fee through again the next week like every other payday loan company does. (Once my freeze was taken off) It was my own stupid fault for not putting a stop pay on them before now.

HOWEVER, they never DIDN't contact me to put through that $400 the day that they did. THAT'S what i'm disputing. She basically told me that once I hit submit, i'm basically agreeing to whatever they choose to do, and asked if I contacted them. When I told her no, why would I if i'm disputing it. She also said she would almost guarntee that they would say that I agreed to it. Btw, I *DID* show her the -mail on how much I was approved for.. and she STILL wouldn't let me fill out the form. Hence, the complaint to NCUA.

Granny, I would if I could drive... and her superivsior is at the main office which is out of buss range for me. When I called she was away from her desk, and when I called, and asked who her supervisor was, I didn't realize the person I e-mailed was her supervisor. So I'm waiting till she gets back to me. The reason I'm e-mailing so there's a paper trail... in case the NCUA etc want to see that I've been TRYING to get my money back.

USFastCash pulled the same "fast" one on me. Once they realized that they could no longer do ACH debits on my account, they attempted to slip an "electronic check" through for some ungodly amount of money. I had a hissy fit. Yes, the bank asked me if this was authorized. I told them no. I also told them this is an unlicensed/illegal company who is not authorized to have access to my bank account. If you have to, tell them you have an attorney "working with you" regarding this. Hell, they don't know. Your branch manager is a nut job. Now, why in the hell would they allow an unlicensed/illegal company to deduct funds from your account? Insane. As goudah always states - What if your checks were stolen or your bank account information fell into the wrong hands or your wallet was stolen? Would the bank even question you as to reversing that charge off your account? NO. They would consider it fraudulent activity. In this case, you went in on Friday & told them not to let these companies access your account any longer. Plus the fact that they are ILLEGAL companies. This is just crazy. In the very beginning, I had to get my banks corporate office involved. It worked. However, my point now is that you need to stress to this persons supervisor that these are illegal companies taking unauthorized money from your account. If they decide they can't help you, you ask them for the corporate office telephone number. Contact the corporate office. And, yes, file complaints against the bank and do not hide the fact that you will be filing complaints. It takes guts to stand up to these people, but you need to in order to get your money back from this illegal company. I hate USFastCash.

frogpatch,I'm waiting to hear back from branch manger's supervisor. I just sent it about a half hour-45 mintues or so ago. if I don't hear back by tomorrow morning, I'll give her a call.

The bank i'm dealing with is a credit union, and I think i'm already dealing with the coroproate office (it's a state credit union-hence the compalint with WI Department of Financial Services).

Just a quick update. I did talk to her supervisor, and she's going to talk to her. She wanted to make sure on what I was signing because if the company decides to sue.. yadda yadda yadda, but she's faxing me the dispute form. I should already have it. I don't work till five so don't know if she faxed it over yet or not.. she said it wasn't on her computer. Once I have that signed, and notarized, I'll have my money back and bounced check fees put back into my account within 2-3 days. So i figure by Friday, if not Monday at the very latest I should have it since Thursday is a holiday here.

She also mentioned something about talking to the other branch manager... and that was a separate issue..

mystic, well, at least the supervisor is "allowing" you to dispute it and you'll get your money back. However, if I were you, I would be sure to mention the fact that "this company is not going to sue" (Good Lord!) because they are an unlicensed/illegal company! I don't think they are comprehending this fact. This "company" is not licensed to do business in the United States, so suing you or the bank or anyone for that matter, is not an issue.

Cannr, yup. I did try and tell her that. I think they were more concerned with covering their backs though.. which to their account since they are a small time credit union, I don't blame them.

I did hear back from the WI department financial services wanting more information. I will wait to see if I get my money back before giving them more information. They wanted to know if i let the loan company know the funds weren't going to be there. In my head i'm thinking ummmmmm noooooo.. how could I until I had checked my account on friday after my paycheck had posted DUH.. but like I said.. i'm holding off responding to them, until I see what my bank does. I wasn't expecting them to be fast. Nothing gets done fast here in WI LOL.
