Can a collection agency put a judgement against you?

I would think that they cannot get a judgement against you if you both agreed upon an amount and you have it in writing.

Also i'd think that if u were indeed making any kind of reasonable payments to them they more than likely would not try to get a judgement on u.... I think they're better off getting the money they're getting now than to take a chance of losing a suit! Now of course i'm not saying this is 100% definate answer but makes sense to me...

If you have been paying them an agreed amount and have proof that you payed it, like your cancelled checks, they would have to be idiots to walk into a court room.

The most likely defenses you raise are accord & satisfaction & abuse of process.

Can a collection agency legally garnish your check from an old unsettled account? I don't deny that I owe SOME money, but not what they are asking for. Today I received a letter stating they would garnish my paycheck. Mind you, it is not the company that I owe the money to offering the threat---it is the collection agency.
Is this legal.

Do they have a judgement against u? Unless this is a student loan they must first have a judgement.
And yes a CA can and do file suit against u.

i have a few questions, i just bought a trailer, and i have it in my name no leins, i have a contract agreement and papers that i have paid signed both my us, they owners before us say they are going to file a judgement against me is that possible saying that they want there money which they have broke the contract and i have it in my name?

I'm not sure exactly of your question. You purchased a home. You have a contract showing you paid for it signed by both parties....I'm confussed. Can you please elaborate a little?

My fiance has a judgment on his credit report and he sent a pay for delete judgement letter to the collection agency but the collection agency called him up and said that she cannot do that. Can a collection agency file a motion to vacate a judgement?

they can! but why would they? they spent a lot of money obtaining that judgment. very few ca's will vacate a judgment for a payment unless they have a really good incentive to do so - ie you owe 15k and instead of settling at 10 you pay in full. even then, most wont do it.
