I filed the DV letter with the clerk of the court too.
I have trial on the 30th-
By the way, on my credit report, the original creditor reported that the account was opened 11/2001. It was last reported 5/2003. Arrow Financial, who "owns" the debt now, says it was opened 2/99 on the complaint. I didn't open an account in 2001 OR 2003.
I live in Illinois, and the SOL is 5 yrs in my state.

Send out a 'good faith' letter to Plaintiff's Counsel as a final request for production before you have to result to Motion practice. Then, file an Order to Show Cause seeking the relief of staying the trial and/or striking the notice of trial due to discovery and if the court stays the trial that the stay not be lifted until discovery is fully completed in the matter. Were you served with the conference order from your last court conference with a discovery schedule?

I have not recieved anything from the plaintiff other than the initial complaint, and now their motion to strike. So I can file something to hold off the trial until discovery is completed?

Motion to strike on validating and SOL expiration? On what grounds? Proving that a creditor has ownership of the debt and that it is not a time barred debt is very crucial in these cases. What grounds could they motion to strike on?
