The letter:
You continue to present a check for $495 to my account. A loan was taken out on June 7, 2007 of $300. I had four (4) rollovers of $90 totaling $360. Please tell me where in Nebraska law or any law thereof that state rollovers and loan term limits beyond a maximum of 31 days are permitted. I know I signed a contract stating that 4 rollovers of $90, and beyond that a $50 fee reducing the finance charge. I just want to know under what State or Federal authority do you have to charge these rates? Since I payed $360 so far in fees alone, I would like to come up with a settlement that's within State regulation and by law on deferred deposit loans.
In other words, I will only pay back what is required by law.
I really don't care if collectors from oneclick cash read this post. It is what it is.

SpeedyNy, I am assuming that you live in NY. These loans are illegal in the state of New York. It is good that your bank is working with you. However unless you close your existing account and open another, preferably at a new bank, this company will continue to debit your account, They will never stop.Especially since you sent them the letter, they will try to hit your account with a vengence. That is why we always reccommend taking care of your account before you send any letters to these people.

I can not close this account unless it is clear of the negative balance, bank policy. My direct deposits are cancelled to this account, so they can debit all they want,it's a dead account on life support by the negative balance :lol:

I contacted my banking authority in NY, They said by going online to get a loan from a payday lender, I am subject to the laws of the lenders State. I will look for that e-mail and post it.

The Nebraska Department of Bank & Finance issed a formal Cease & Desist Order to One Click Cash on August 29th. If they aren't legal in NE..they certainly are not legal in NY. Just thought I'd share the information.

They gave me a loan for 300.00 It was supposed to be 390.00 pay back but the debited my account 90.00 theb 480.00 then 6 mo later another 90.00 I ask the manager to Fax me the so called contract that says I pay over 572.00 to me and they have yet to do it My account got vcharged over 100.00

If you pay back what you owe - legally, meaning what your state law says you owe - then you don't have anything to feel badly about later.

It seems that the AG's that do issue cease and desist letters do not think that they should be paid back because every time a suit happens the company lending illegally gets stuck not being able to collect all the loans that they gave out illegally. I personally go back and forth within myself on this issue.
