These people are ignoring me. And the fact that they haven't cashed my check has me with a weird feeling. I also wrote wells fargo about this account to see if I can start sending payments directly to them. I have written them over and over again about this account. why am I having such a hard time trying to take care of this account??? its not like I'm a dead beat and trying to run from them. I am begging them to let me pay them. weird. its almost like this account doesn't exist. I mean, normally, I'm used to CAs hounding me to death. Yet I can't get anyone to talk to me about this one. thanks for any input. shirley

Good to hear that you are trying to repay your debts. It's really surprising that the CA is not responding to you and seems to be not interested to collect the debt. You can contact your OC and inform them about the fact, but as the account is sent to collection agency already, OC won't take any interest in it.
You try to call the CA this time, as you have already sent some letters and have not received any reply.

Keep the records of your payment safely. If the CA denies or charge a huge amount in future, you can produce these documents in your support.

Just in case I ever have to prove anything--I can show that I have tried to take care of this account. IF OC hasn't 'sold' this account and CA is 'in house' then maybe by writing the OC, they will tighten up and we can start to work on this. again, its so weird that I'm not hearing anything---period. no threats, no phone calls, no letters...and when I write them and send them money---nothing. I am going to see what happens next and if nothing, then I'm going to lay low about it. BUT will still hold on to records just in case it rears its ugly head up later down the line.

Shirley, there is a provision by law that if some information appearing in your credit is hurting you and that the creditors or the collection agencies are unable to provide you the necessary information, you can get it removed from your credit file.
Since you have tried in every possible way to communicate with the said companies and they are not responding to any of your mails, you can explain the situation to the bureaus and get this item removed from your credit file.

I have been doing alot of thinking and have decided to contact the credit bureau about this account (the account from which this thread originated-wells fargo financial) and the dell accounts. Wells fargo has said this account is with a 'in house' collection agency, which doesn't make sense to me. But if so, their communciation skills suck--big time, and they don't seem too interested at all, in trying to get their money back. This was a secure loan for $2000. and well, you remember, all too well, the Dell accounts. So I'm thinking of contacting the credit bureau and seeing what can be done from there, if anything. Obviously I'm beating my head against a brick wall with trying to deal with CAs and OCs on these accounts. This might not get me anywheres, but its better than not doing anything at all. At least I feel I'm trying. :roll: shirley

It's good to see you posting in the forums. How are the letters (communication) to the credit bureaus going? You can also make a complaint against the collection agency ignoring you, with the BBB.
Also, "in house" collection just means that they have their own collection department, which is probably just a different area of their call center. Although its still a collection department, they're usually better to deal with than an outside agency.

There is a very great importance if you correspond with any agency through mail because you will have a proof of everything you have done so far along with their responses (or sometimes may not, which puts you in strong position). You can always choose to make the dispute online, but you won't have any proof if you are put to defend yourself later. I hope you know what I mean here!
I was giving a thought last night about your situation when the CA is not responding and the creditors are not working on your accounts. At this situation, you have the right to dispute with the bureaus and they are required to update you with the necessary proof of their investigation done within the 30 days mark.
If the credit bureau does not respond within the 30 days, you have the right to send a follow up letter asking for immediate verification. If they still fail to respond to you, a copy of the entire situation should be forwarded to the FTC along with the credit bureau. By this time, things are expected to get sorted out.
If all fails here, then you have the right to add a 100 word statement in your credit file. This description will depict the inaccuracy to your future lenders and you will prevent your credit identity from getting hampered.

I was thinking of drawing up the letters (not sure how to go about that--do I go into full details or is there a proper 'form' way I should do it) and if I don't hear anything after that, back myself up with going on line and posting same complaints/disputes with another certified letter to follow asking for verification-as you suggested. A follow up letter should be sent to the bureau after 30 days from the date of first dispute letter sent. Frame it explaining that a letter was sent 30 days ago and the CRA has failed to give you the requested information. Thus, please give this letter the urgent importance.
To add a 100 word statement in your credit file, you can use a letter with the matter given below.

As soon as I get the small ones paid off, I will put that money into the bigger ones and get them paid off faster. between me paying them off and getting that put on my credit report (that I paid accounts off), and me disputing things with the credit agency, it should all come together. I am hoping!!!! as I said, if the bottom doesn't fall out from under me on these other accounts, things will look real good for me this upcoming year. What I need to know is this. After looking over my recent credit report---I noticed that accounts that are MINE and in my name ONLY, are on my husbands report, but also on mine as well??? If there a reason for this? I was going to tell them to take these off. They aren't joint and I don't understand why they have them under both names??
Sams club is mine and mine only, but they have it listed under both of our names and they're the ones that just took me to court so I will have a judgement now showing---and it will be on his as well as mine-when its my account. also I have a BP gas card---very close to being paid off, but it is listed on both.
Can I dispute all of this above PLUS all
of the dell accounts, the one wells fargo, all in the same letter? just make a list of it all?
Then it has to go to all three bureaus. Plus then I have to dispute the wells fargo on MY report along with the one Dell account on mine--and that also needs to go to all three agencies. So six letters going out to credit bureaus.

Okay, so someone tried to steal my husbands identity and get credit under his name and apparently, its the people that live across the street from us.
Further more, its my husbands brother that lives in that house. His sister was living over there too, before she died.
so, someone uses my husbands name and they just automatically put it on the report. wow, how easy would it be to help screw someones credit up! But everything on the report is ours, nothing that doesn't belong to us, as far as what I can tell. We have some old stuff thats been paid off, but I wasn't going to ask them to take it off, since its good stuff that we did right on. doesn't that help my score and show creditors that at some point before this mishap, that we were good debt paying people?
So, can I dispute ALL of this on the same dispute letter???
I have one other account to dispute as well. Was just wondering if I could do it all at once??

Since you have not signed this debt with your husband, dispute it with the bureau so that they can furnish the results of their investigation done.

Credit bureaus can conduct investigations on multiple disputes but you will have to allow some time for their action to complete. After the investigation is complete, they will provide you the updated copy of your credit report

As it is not hurting your credit, let it stay on your file. It is giving good view to your lenders.

Dell says that can't help me, yet ca won't answer validation request (still haven't after sending two request---but the one 'oxford' still calls my house every day, even after sending certified Validation request and no phone calls/written correspondence only). And this is just the current CAs that have the accounts---lost count on how many have had them _all together_. Then the one wells fargo that STILL has yet to correspond to me and I had to threaten them to get them to take my money-still nada from them. so we'll see what happens. It can only get better from this point. If they can't do anything, then its not any worse than what it already is. right---seeing the glass half full here.

Before that, the bureau has to give you the results of the investigation done on these accounts. They just can't write saying that the entries are correct. They need to prove it, otherwise you can report the matter to the FTC.
Once you have added the 100 word statement, anyone viewing your file will come to know that the information is disputed. Once it is attached in the file and the dispute is reflected, usually all creditors co-operate with the consumers. If anyone does not, call the state attorney general's consumer-complaint hotline.

I was requesting something in writing stating that we had an agreement. nothing. so now what, if anything, should I do? just sit tight? I got all six letters done to the credit bureau (one to each bureau for me, and the one to each for hubby), also, remember the phone call that was in question last week? I went ahead and wrote them questioning who they are, explaining my no phone call policy along with validation request. Then got a letter on monday from a lawyer to hubby--don't know what thats about--so sent them off a validation letter as well. eight letters sent certified return receipt. cost about $35 and some change. but if I'm going to try to take care of my business, have to make sure I do it the right way. I was right in sending the letters to the bureaus that way, right? (C&R)
