Payday Loan Trouble in ohio need advice

I have 13 store front payday loans. I am trying to make payments but for ACE cash express I cannot make any payments. I froze my bank account in Oct. and my check for $460 returned to them “account closed.” I have set up several arrangements with them but missed them all. They said now if I dont pay them the full amount by Nov. 30 then it goes to legal and they may pursue criminal actions. What should I do will I go to jail. I thought this was just a civil matter? I am really scared now


In Ohio there is a "bad check" court that payday loans can take you to. It's not the normal bad check court, it's specifically for payday loans. You are put in a room with the lender and a mediator, and you must agree to payment arrangements or to pay in full. I'm pretty sure, but not positive, that it doesn't go on your record as long as you keep the arrangements.

They are blowing smoke, it really is a civil matter. I live in Ohio and I read the court dockets every day for my city and I have never seen a storefront pdl take someone to criminal court, only civil. If you don't pay them, they will take you to civil court. Is there any way you can pay them some of what you owe, even if it's not the whole thing? If you have missed paying on the arrangements you had with them, it is likely that they will go ahead and take you to court but it is worth one last shot at making payments with them. Where else do you have loans out, and are the other places being cooperative? BTW I am in Ohio also. Let me know if you need anything.

More than likely they are blowing smoke at you but it could be possible since the account is closed.

Goudah- Mediation does not go on your record in anyway I can find so far. My court system is online and nothing shows up for my name for mediation. I have checked my credit report and nothing has showed up on it either.

I would make arrangements ASAP!!! And stick to them this time. It seems to me that you could very well be charged w/ some sort of crime. I mean if a county prosecutor took the time to look into your case and discoverd that you had defaulted on 13 differant loans I think they could pursue it. It seems this would not be the same as the average Joe who gets into trouble w/ 3 or 4 PDL's and then cant pay. That would almost certainly fall into a cival dispute and handles by that PDL court thingy Ohio has. But 13 loans!!! That might be another story!! I dont mean to scare you, I just don't want you to get into any trouble.

Before I signed up with my debt consolidation company, I had 12 payday loans and I never went to jail or any trouble. Mvosu1 probably fell into a trap like others did. It took me 3 years to rack up 12 and I always thought I could get myself out. You can't pay off one so the company tells you to go to their sister store. Then you have one at the sister store and need another one. Then something breaks and you have another one and so on. Ohio check thingy has nothing to do with the local courts. Most bigger storefronts in Ohio will send you to collections. The small chains stores I would worry about a little but then they would probably take you to small claims court.

I know the ohio check court has nothing to do with criminal law. But that dont mean anything to a county or municipal prosecuter. All i'm saying is that it IS possible criminal charges could be filed. Not likely, but possible. I just think we should be careful when we tell someone that they will not be charged with a crime.

Well, I can chime in. Express PRA and CheckSmart, are not nice people! I thankfully paid them both off today. I know this was not the best route to take, but I got a couple credit cards to live on and we used our paychecks to pay them off. One collection call from Express is all it took for me, but I'm weak, at least that's what my husband said! LOL, anyway National check cashers has been pretty nice, they let me pay 1/2 today and I'm going to pay the rest in two weeks. When I paid Express today the manager says, "thanks for paying and remember you can re-loan whenever you want to", since this a "family friendly" site I can't repeat what I said back to him, but it wasn't nice! I so wanted to hand him my business card and tell him when he got tried of ripping people off to call me for a real job! I'd rather have both my legs cut off then to ever walk back into that store! It was him who called me and told me to get some character and integrity! I feel so sorry for you, I've made myself sick just like you for weeks now. I still have 2 internet loans I'm going to have to deal with. Ryan, is well versed with a lot of these lenders, he has been through it and survied. If you can stick to your guns, you can make it through it, just don't cave like I did.

I would tell them to contact Town and Country. I believe only three bigger chains turned me into collections. Check-N-Go turned me into a collection agency but they are cashing T&C $12 monthly payment. Another store turned me into the Bass famous agency and they were something else to work with at first. Every time they would call my work I would give them T&C number and tell them to contact them. T&C had a signed propsal from that store but some reason they wanted to turn me to a CA. The other one I never heard of but T&C sends them a check monthly. Other big chain stores will do in house collections and never had a problem with them.

Guest - They could be charged with a crime but do you really think a prosecuter will take the time for a pdl or two? You will most likely see it brought up in small claims over crimial matter.

I was charged with passing bad checks in Clinton County after defaulting on a loan in Wilmington Ohio. At court the judge ordered me pay back the loan amount, plus the late fee's, plus court cost within 30 days. After I did that, the charges were dropped. Bad thing is that the charge is still on my record. It says the charge was "dismissed", but it still on there. I was also ordered to undergo credit counseling.
