Pre-litigation settlement offer

I had a phone call today from some "litigation" company that claimed to have a Conseco Mastercard collection account (which is not listed on my credit report anymore as as the sol and drop off date is more than 10 years now) and she got all nasty with me. Can they still claim in court? I said the debt was too old to collect and they should send me validation information. She claimed that it already was sent (to my address from 11 years ago--as if that is current) and that they did not need to do that and that she needed my current address. They called me at my mother's phone number which is my current number and address. I said that if they called me at this number then they should already have my current address. She said "That is so silly. Do you know how many people tell us that. We'll just sue you then." Then she went off onto a tangent and I hung up the phone. I don't have any info from that long ago, can they still do anything?

Threatening a lawsuit after the sol is passed is a violation of federal and some state laws. Sounds like they could be paying you instead.

If you do please post the company name and I will try to get you information and an address to send a cease and desist letter to and also a debt validation letter. It sounds like one of those junk debt buyers. They are usually pretty easy to get rid of but they will only respond to certified return receipt letters. You can say all you want on the phone and it means nothing to them!
