Fax vs certified return reciept your opinion?

I have been doing both with a law suit that I am involved with. I started to just use the fax machine on certain items of communications like C&D's and it works. I would like to here what everybody has to say about his.


In my practice, when utilizing correspondence with Plaintiff's Counsels and junk like that send them out by fax and certified RRR. You can do both to cover yourself, that way you have the green card and fax receipt; it helps out better in court before a Judge (from personal experience in getting cases marked off the trial calendar).

I am a fan of both. I like the instant delivery of the fax, but I don't always trust that the fax goes where it should go, and not in the trash. But you do get that confirmation page.

I always follow the fax up with a certified letter. Then you get your green slip, and proof of signature. That way if anyone tries to tell you that you didn't mail it, you have dead proof.

Doing both covers you both ways! :D

Unfortunately, if you're unemployed for 9+ months, it gets kind of expensive sending it CMRRR, especially at 5 to 7 dollars a hit. I've had to rely on mostly faxing things to CA's. I even put of the cover page a comment to the effect that "the total number of pages is X, if you don't receive all X pages notify me at XXX-XXX-XXXX. Otherwise I will consider this fax confirmation proof of delivery" I haven't had a problem with it so far.

The problem of a CA "losing" faxes is just that, their problem. They need to look at better internal controls to ensure the faxes are treated with as much seriousness as a CMRRR letter. I'd be willing to bet if you were faxing a signed "payment agreement" to them, that would be treated as gold. The same seriousness needs to be taken when they receive faxed DV and C&D letters.

I also find it amusing that CA's dont' want to give out their fax numbers without a fight. Sometimes the same can be said fo their addresses, too.

Just my opinion.
