Offered a settlement
Date: Thu, 11/29/2007 - 09:35
Been busy for the holidays, but got a settlement offer from Forster and Garbus. They want to settle for 2800 with payments per month or @2000 in full by Dec. 20th or so.
They also sent me a set of interogatories (sorry for spelling) to answer.
Basically I sent answer and motion for dismissal (no counterclaim) and they send some opposition to motion.
So we are both waiting on the judge.
What are these interagtories about??
Thanks

Thanks Law Student!
Now I know I have to answer the interrogs...but wouldn't you know they made another mistake??? Instead of lvnv apo hsbc, they have lvnv apo citifinancial. The WRONG Plaintiff.
This is the 2nd mistake that they've made with my caswe. Even if I could settle, which I can't cuz I've got no income....who's to say that they won't mess up the payment and come after me again. They are making mistakes every time I turn around!!
They also sent some credit card statements from my account, but not the original credit agreement with my signature. None of the statements (from my brief examination) say either HSBC or Citifinancial...they only say Gateway, which was the store from which I opened the account.
So, this is my idea - I am not going to take the settlement because it's not that great. I mean if they said 1000 - 1500, I might consider it, but the full amount? nah!
I am going to answer the rogs and wait on the judge to rule on my answer and motion to dimiss. I don't have a counterclaim.
Now when I answer the rogs, I am going to answer exactly to the letter of what they say - since I never entered into an agreement with citifinacial nor lvnv, then I can answer most of the questions in the negative.
Why are these people so careless?
