I took out a $300 loan with Interim Cash in March 2006 and defaulted in September 2006. Since then, I have paid back a total of $350 which satisfies the loan amount plus the fee. Because the loan defaulted and I didn't pay back immediately, they are trying to say I owe them over $3000 but will settle for $300. BS!!! Well as far as I'm concerned I don't owe them a penny more but I want to be well informed. I've checked the California Secretary of State and the CA Dept of Corporations and can't see where they are even licensed to do business in the State of California. How can I make certain? Does anyone know if they operate under a parent company?? Am I right to refuse anymore payment? They're threating to send a wage garnishment which I don't even recall signing a consent for. Does anyone have any advise??

They cannot garnish your wages without a court order, which they could not get because your loan with them is not valid. They are not licensed anywhere in the US. They are based out of Great Britain and claim that their loans are only subject to British laws, which is crap. Their loans violate British law as well.

I'm guessing that like all of their other clients, you were never issued any written or electronic loan documents. They simply recorded your conversation and said that the recorded conversation was legally binding? Obviously, not true....

Anyway, I would recommend that you advise them that you are filing complaints against them with the BBB and the California Attorney General's office or similar that handles these types of complaints for your state.

Only after I filed a complaint against them did I get them to close my account and mark it as paid in full. I had a $200 loan and paid over $600 in finance charges before I found this site and realized that what they were doing was illegal.

Interim might be talking about a "wage assignment", which the overseas illegal pdls like to do. They will send a "wage assignment" to your employer to attempt to get money from them & they would then take it out of your check. You need to type up a quick letter to Interim and revoke any and all wage assignments you may have signed with them, their partners, or any affiliates. That's all you need to say. Type your name. Fax it/email it/mail it certified mail to Interim. Keep a copy and give a copy to your HR/Payroll person at your place of employment. Wage assignments are totally voluntary. However, a lot of employers do not know this. You may want to educate them regarding the fact that this is an illegal company trying to get funds from you. You need to do this now before Interim has the chance to send a wage assignment to your employer. It'll cover your butt just in case they do. There's been a lot of wage assignments flying around lately.
