Can a collection agency process a payment through your bank after you called and told them not to because the funds would not be available? Then they tell you either come up with the money or have insufficient funds with your bank and I will have to deal with it. What kind of collection agency process a payment regardless of the situation when you called to work out a payment on a different date, and they basically tell you oh well tough luck on your part. I know I have rights and they can not just do this without my permission. What can I do to make sure my rights are not violated?

If you're dealing with a post-dated check that was run through early, they aren't supposed to be able to do that. I'd definitely be all over the bank if they let this happen. Electronic debits are trickier to prove the dates on because there's usually no paper to fall back on. Good luck, and tell us how it works out.
