So I did a PDL and certainly not proud, but intended on paying it back.
It was with CTC. I have been unable to pay it back.
They kept threatening wage assignment, but in SC it is illegal to garnish wages unless it is court ordered and for child support or an IRS levy only. No other debts can be garnished in SC. I know this and told them they can try all they want, but that it was illegal.
So guess what- they tried- they sent over this bogus letter to HR. HR called me up to the office. I played dumb and pretended I knew nothing about it.
HR had already called our attorneys and the attorneys confirmed that only with a court order could a wage garnishment be in place.

My question is does anyone have experience with them after they attempt wage assignment? What are their next steps or will they just go away?


They are known to send these to nearly everyone that defaults, luckily I live in PA which is a non garnishable state. Wage Asssignments are different than garnishments though and are voluntary. You can just send a letter to CTC revoking wage assignment revocation letter to them. I am sure Cannr will respond to this and give you all the advice needed.

It was not a wage garnishment which you need a court order for. What was sent was a wage assignmnent You sign this when you apply for A PDL. Some pdls use it, some do not. a wage assignmnet is strictly voluntary and can be revoked at any time, However it shoud be revoked before it is sent to your employer. I am glad your employer is working with you. If you have other loans out I would certainly revoke any wage assignments you may have given them.

travlgrl, yes, I had Cash Transfer Centers send a wage assignment to my employer. It was not honored. I haven't heard a word from them since. (Knock on wood!)
