-names of the PDL companies you are dealing with
-whether the PDL companies are internet or storefront based
-how much you borrowed
-how much you have paid (including any fees)

They can threaten you with legal action but they can not follow through...They are not legal in your state. An illegal pdl will not try to take legal action. As for turning you over to collections, again, you can fight this, the CA will not be able to collect on an loan that is not legal in your state. They will try and try to intimidate you into paying but you will have recourse. If they turn you over to a 3rd party CA, you will have the fdcpa on your side and you can request a validation of the debt which they will not be able to do.

Maricia, I am in a state where they are prohibited as well...I had nine and so far, no legal action. Like Kash and I both said, it would be very difficult (and unwise) for an illgeal company to take legal action. They would not have a leg to stand on in court becuase your state does not recognize them as legal. fdcpa is a law and it is listed on the top of the dealing with collection agencies fourm as a sticky. If they send you to a CA, which four of mine did, just post and we can tell you what you need to do.

If PDL's are illegal in your state, a company would be very foolish to spend the money to even file in your state as they would have no leg to stand on. What some companies have done is filed in the county and state where they are based--but in that case, you can make the claim that you never did business in that state and they would be in for a court fight.
