Does anyone know if Texas store front's are required to allow you to make payment arrangements or do they automatically start legal proceedings.

Many storefronts in Texas are now operating as CSO's. If they are operating as a CSO, then they do not even have to follow the Texas pdl law. Check your paperwork and see if anywhere on there it says they are a CSO.

ralw03, is cashinminutes an internet pdl? Pdls are prohibited in New York. So I'm going to assume it's an internet loan. No, they're not going to file any charges against you. It's they who are breaking the law.

I talked to someone about debt help and was told they couldn't help with store front loans but if I let it go to collections then they could help make a settlement. I am afraid if I let it default they will prosecute and I will be in more trouble. I can't see a way out of this mess if they won't let me make pay arrangements. If I make pay arrangements does the interest stop then. They are charging 500% every two weeks.

Does that mean they won't let me make pay arrangements
Will they just file charges against me without trying to let me work out something. I know that I owe them and am willing to pay but I have already given them over 900.00 in interest.I can't get them paid off because I have to come up with 300.00 interest every two weeks. I am desperate for a solution.

msgreen, have you called them yet and asked about setting up payment arrangments with them? Or have you not contacted them yet?

I contacted them and they told me if I would pay 326.50 which is finance charge they would refinance my balance for another two weeks and restore my status to Preferred Customer immediatley. If I had the money I would have already paid them. If I continue to pay at this interest rate I will never be able to pay them off.

The loan was for 1500. I have paid approx 1200
in interest and owe 1746.00. That is the only offer so far. I don't know if I should ask to speak to someone at the corp office. I am willing to pay what I owe, just can't do it if they keep adding the interest. I think it is 500%.

Thank you for your advice. This is the biggest mess I have ever been involved with. I had a loan with them in the past and it took me about 8 months to pay off but I never missed a payment.

I talked to someone today who I think is the manager. She told me the same thing and said she was not able to offer any other arrangements such as EPP. I asked for corp phone number and she told me to give her a little time and she might be able to work out payment plan for me. It was encouraging to know she wasn't ready for me to call the corp office. I had another loan with Quik Cash, also store front. They were more than willing to offer EPP on the principle. Things are looking up. I am confused about another loan with Advance America. I called and spoke to someone who told me my loan balance is zero. Does that mean they have already sent it to collections,it just defaulted 2 weeks ago. Sorry for all the questions, I am feeling better about my situation. I do have 3 internet loans but I think only one of them is legal

msgreen, at Advance America - the storefront, correct? - they told you that your loan balance is zero? Did you ask them if they have turned you over to a collection agency? Advance America - the storefront - is a member of the CFSA; however, the loan is already in default, so we can't invoke the EPP. Some storefronts will just send a defaulted loan directly to collections without even contacting you. That's just some. I'm not sure of Advance America's procedures. I'm glad to read that your other storefronts are 1/2 way cooperating. Now, you have 3 internet loans also? Who are the companies you have them with?

Advance America is store front. I sent certified letter to all of my loans before they defaulted asking for pay arrangements. The internet loans are
The Little Loan Shoppe, NetCash USA and Cash Central. I know Cash Central is CSO. I have been paying interest on all of them for several months. I received answer back from all three of these after sending certified letter. I am going to try to call Advance America again tomorrow.I closed my bank account before I defaulted and everything has been returned as account closed. The bank waived the fees which also was a surprise.

Yes, call Advance America and see what they can do for you. I'm praying some kind of payments that you can afford to live with. Your Little Loan Shoppee will not be licensed/legal, msgreen. I'm not POSITIVE about NetCashUSA. I'm sure someone will come along and post if they are licensed/legal. Did you make some kind of payment arrangements with these internet lenders?

Thank you. I have to admit I am encouraged after dealing with Quik Cash and The Cash Store. If I can make arrangements with Advance America I should be out of the mess in about three months.
The Little Loan Shoppe borrowed 300.00 Pd 360.00
I emailed them about arrangements and they emailed me back and stated I owe them 505.00 and can make monthly payments by money order.

NetCash USA borrowed 400.00 Pd 360.00
Someone from ZipCash responded to my email about arrangements and stated I owe them 520.00 and can make monthly payments by money order.

msgreen, The Little Loan Shoppe - you have already overpaid. They are unlicensed/illegal. You have paid them $60.00 over the principle amount. They owe you a refund. You do not owe them $505.00! That means that you would be paying $865.00 for a $300.00 loan! NO! And is NetCash & ZipCash the same place? You borrowed $400.00 and paid $360.00 and they say you owe them $520.00? Good Lord. That's paying back $880.00 on a $400.00 loan. Crap! However, goudah has checked and found that ZipCash is operating as a CSO in Texas, unfortunately for you. You will have to make your arrangments with them. However, the Little Loan Shoppee is out of their cotten picking mind! Illegal!

P.S. Thank you, goudah, for looking that up! :D

Thank you for the info. Atleast I know that one if off my list and I did receive an offer for pay arrangements from NetCash(ZipCash). The manager from The Cash Store left me a message to call her tomorrow and she will let me know what they can offer.
I still need to talk to Cash Central and see what arrangements I can make with them. I haven't been able to find out what happened with Advance American
At least I was able to keep my paycheck for the first time in months.

When I borrowed from NetCash they emailed copy of contract. This is info that was listed, they list the interest that they charge. Is there any way I can email them and request a settlement or am I stuck paying all of it since they are CSO.

I believe you're "stuck" since they are operating as a CSO. However, goudah will most likely see this. She can offer more insight. Just hang on! :D

I closed my bank account before the 11/16 payment and sent them a certified letter asking for pay arrangements.
Since the Little Loan Shoppe is illegal I decided to email them and tell them I had already paid 360 on 300 loan and wanted my account to be noted as paid in full. Looks like they have plenty of loop holes. This is part of email I receieved from their legal department.

Okay, they are Utah based (and all pdls state that their law "governs" your law, blah, blah). Are they LICENSED in Utah? Are they LICENSED to lend in your state? They can spout all they want. They're full of BS. You've paid them. They can stick their $505.00 unless they are LICENSED to do business with you. And, you go by your state law.

Thank you for the info. I have received a lot of great advice from all of you. I emailed them back yesterday. I told them that I intend to file a complaint with AG's office. So far I haven't had response to second email.

I am starting to have questions about Quik Cash. They are store front but not sure if they are CSO. I talked to someone who said she was the manager and she told me I could make arrangements. I agreed to come in and make a payment on 12/14 which I made today. I got a letter in mail from them today stating I had 10 days to settle and I thought it was pretty funny that nobody signed the letter. It isn't even a professional letter stating who sent it. When I made the payment today they didn't even have me sign anything, just gave me a receipt and asked me when I would be back in to make another payment.I can't find anything stating where the corp office is located. Does this seem a little strange?
