As clearly stated in the loan contract, which you signed, this loan is not governed by the laws of America nor the laws of the state of Arizona, it is governed by the laws of Ireland with the jurisdiction of Dublin courts. As per the governing lending laws, your interest charge is $37 per $100 per pay period. We will continue to collect on the loan as per the agreement - failure to abide by the agreement will result in your loan being forwarded to collections for further action. If at any time you wish to pay your loan in full, please let us know.

For instance, if they know that someone is filing complaints, etc., it they communicate that with each other. I haven't heard a thing from any of them yet, other than the correspondence that I initiated with ACHLOAN.com

tina, it would knock your socks off if you knew all the names some of these companies use. Some have up to 20 d/b/a's. They are amazing. It's all the same company; however, they issue loans out under different names. BIG/SONIC/ROUTE 66 is a prime example. They use many, many, many names. MTE Finacial is another one with more names than you could possibly imagine.

I just got an e-mail from BIG saying that my payment was returned and if I would like to discuss it with them, I can call them, blah, blah. I just replied to their e-mail with the letter that you sent me, which I had sent them yesterday (before they sent the e-mail about the returned payment).

tina, do NOT speak via telephone with these guys. Okay? They will harrass the living hell out of you. Only communicate via email or USPS. (Which they hate and will call you 1,000 times.) Keep sending the same letter to them. That was the right thing to do. Now, I know in the letter you sent, it did mention revoking wage assignments. However, I want you to do a separate letter to each one of them revoking wage assignments, okay? Just type what it says on the letter I sent to you regarding revoking wage assignments signed, but do one for each of these guys. You will need to email it/fax it/mail it certified to each one of them. Keep a copy and give a copy to your HR/payroll person at your place of employment. A lot of the illegal overseas pdls will try to send through a "wage assignment" to your employer to get their money. A wage assignment is totally voluntary and can be revoked at any time. However, a lot of employers are uneducated regarding them. You may just want to tell your HR/payroll person to put that letter in your file "in case" these illegal overseas companies try to pull something with you. Explain to your employer that "somehow" (they don't need all the details) these illegal overseas companies have gotten ahold of your personal information and are trying to get money from you. Just cover your butt. Send the letters revoking wage assignments and give a copy to your employer. Educate your employer regarding the fact that wage assignments are totally voluntary, these are illegal, unauthorized, overseas companies. If you have any problems, let us know.

tina, I'm not positive. You may be correct on that one. The state might actually laugh at a nice illegal wage assignment. However, me being the absolute paranoid person I am after dealing with all this, I would still do the separate letters revoking wage assignments. I'm all for documentation. The more documentation you have, the better off you are. If you can ask your employer (without looking foolish) if they "honor" wage assignments (gee, from illegal overseas companies) and they say "no", then don't worry about it at all. But I would want to know for absolute sure before I decided NOT to send the letters revoking it. Just call me paranoid! :wink:

They told me that it is a valid debt and that they will continue to do what they need to do to collect it and when I am ready to pay to let them know. I told them that I've already paid them and that in actuality, I overpaid them by $10.00 and they owe me a refund. They said that I won't be receiving a refund and they will continue with their efforts. I hope they don't hold their breath waiting to hear from me : )

I'm jumping in here. The wage assignment that I received at my place of employment was FAXED. It was NOT sent through the mail. So if your pdls have your work number, they can get your fax number, and they can FAX the wage assignment. Believe me, been there, done that.

I posted on there the PIF letter and the letter to stop phone contact and revoking the debits (even though I already closed my account) and they actually did respond back to me. Not the response that I was hoping for, but at least they did respond and they know where I stand ; ) Anyway, just thought I would let you know what I did with these fools. Good luck!!!

From what I've been informed by the FTC & my state's AG, you have no legal recourse and since I've already made good on the principle amount that I borrowed, you should consider this debt paid.

ACHloan, huh? Oh yes, I know them VERY well! I'm working w/ the State Financial Commission here in Maryland, and payday loans are illegal. The people w/ Maryland Financial Commission told me to tell ACH that their operations are illegal in Maryland and that I don't owe them any money, and that, after I've told them that, when ACH calls up, to hang up on them. Well, that really doesn't work, as they keep calling back, and if they call at work, they've tried calling my coworkers' lines. I told my coworkers the bare minimum of what was going on and told them to hang up on them. That doesn't work either, so I just let ACH give their spiel; They say "you are being recorded," I tell them, "You're on a speaker phone and we're all laughing at you." Then they've threatened to come and "get" me - I mean, these people are apparently calling from a call center in New Dehli, India, I told 'em to come on ahead! And now they're saying that they'll see me "in the British Court." Yeah? As for contacting them by mail; does anyone actually have a valid address for ACHLoan? Maryland Financial Commission people said if I could get one for them, they'd try writing, but no one at ACH (whether on the phone or on their customer service section of their website) has been willing to give me their address OR a valid phone #. The number that will probably show up on your phone has, I believe, an area code out of Utah, but when you try calling the number back, all you get is "beeps." I'm just waiting them out, hopefully they'll eventually get tired of bothering with me.

If there's a valid phone number/address for achloan.com out there, I have yet to find it. I tried their customer service section on the website and asked for a phone #/address, with no luck. If you don't want them taking more money, the best thing, as many others have done here, is to close your checking account. Then when they start calling you (and, oh yes, they WILL), if you want to pay them back, you can see if talking to them will do any good. (However, they're not much good at talking, just making empty threats)
