new to this forum, but seeking info on laws here in texas. like many, i kinda got stuck in the PL trap and rcvd a phone call this morn from "someone" threatenting to come pick me up for hot checks and then got transferred to someone else even more hostile after i started asking questions! i was just trying to figure out who they were and what their exact intentions were....they went on to further threaten me w/lawsuits and even a 5-10 jail sentence~which i find somewhat hard to believe for a OL amount of $300. can someone pls refer me to an explanation of my rights vs. their rights. i would like to settle the debt and they offered payments, but i do not want to be threatened, harrassed at work or intimidated. pls help!

Hi and welcome to the forums!
And we don't want you threatened or harassed either! First off, we do need to know whether these loans are storefront, where you actually went to a business to get them, or internet. Also, how much were they for and how much have you actually paid with fees?
You also need to educate yourself on Texas state law for PDL's. Go to Paydayloaninfo.org and click on Texas for this information. You will soon see that the laws do vary from state to state.
Good luck and keep us posted!

the loan was storefront at a check-n-title for $300 and has since been sold to a really hostile CA (metro collections out of dallas). its not that i dont want to pay the debt---i am willing to pay it off the best i can (recently separated from husband and trying to make it on my own), but i dont want to jeopardize my job, etc.
on the phone this morning, the rep acted like he was law-enforcement and told me he could be at my place of employment w/in 20 minutes if need be. when i told him i needed verification of the debt, etc. he seemed to calm down a bit and referred me to another number w/my "case" number....i feel like they misrepresented all the way around and now im just wondering what to say next time they call. the OC told me that the CA has been known to even show up at ppl's workplace to collect debts. can they do that?

p.s. thx btw for the prompt responses. i appreciate it sooooooooooo much!~

I can't believe that there are still some collectors who are that stupid. Next time, ask the collector if he/she wants to be a party to a law suit against their company. Also, in Texas, what they did were criminal acts, as well as violations of the state's deceptive trade practices act. Here's info from that state's attorney general:

can someone tell me where i can find a sample cease letter (????). i suppose i will start there....one of the CA reps has already called my place of biz twice and my cell phone once today and its only noon! i told him that the person he was asking for was not in yet and he left a msg divulging that he was w/the hot check division of credit services. how embarrassing that would be if my super or one of my co-workers answered the phone. A$$!

awesome idea, i will do that. they have already called me now 5 times in just 2 days. i read somewhere that i should also send a cert letter explaining that it is not permissable to call me at my workplace and to send appropriate correspondence via USPS only....dont they have to send appropriate
docs/verification of debt by mail before they start to contact you in person? im also afraid that they may show up at my job...what should i do if that happens?

btw, i appreciate all the help so far...

how come i cant find a physical address on these folks? does that strike weird? im not sure if i can send a cert letter to a PO Box? plus i found where they are listed under three different names online: metro credit services, texas credit services and then just credit services....i will continue to look or may end up calling them...ugh.
